Plaintiff, named above, has filed a lawsuit against you in the Superior Court of New Jersey. The Complaint attached to this Summons states the basis for this lawsuit. If you dispute this Complaint, you or your attorney must file a written Answer or a general Appearance in accordance with R. 5:4-3(a) with the Deputy Clerk of the Superior Court in the county listed above within 35 days from the date you received this Summons, not counting the date you received it. The address of the Deputy Clerk of the Superior Court is: Superior Court of New Jersey, Bergen County – Family Division, 10 Main Street, Hackensack, New Jersey 07601.
A $175.00 filing fee payable to the Clerk of the Superior Court must accompany your answer or appearance when it is filed. You must also send a copy of your Answer or Appearance to Plaintiff's attorney: Fava Law LLC, Sandra C. Fava, Esq., 6 South Street, Suite 203, Morristown, New Jersey 07960. A telephone call will not protect your rights; you must file and serve a written answer or appearance (with fee) if you want the court to hear your defense.
By Order of the Superior Court of New Jersey dated May 8, 2026, Plaintiff has been permitted to effect substituted service by publication due to inability to locate Defendant after diligent inquiry.
If you do not file and serve a written Answer or Appearance within 35 days, the Court may enter a judgment against you for the relief Plaintiff demands, plus interest and costs of suit. If judgment is entered against you, the Sheriff may seize your money, wages or property to pay all or part of the judgment.
If you cannot afford an attorney, you may call the Bergen County Legal Services office at 201-487-2166 or the Legal Services office in the county where you live. If you do not have an attorney and are not eligible for free legal assistance, you may obtain a referral to an attorney by calling the Bergen County Lawyer Referral Services at 201-488-0044, or the Lawyer Referral Services of your county.

COMPLAINT FOR DIVORCE
ROSEMARY T. KOKUHILWA, Plaintiff,
vs. MICHAEL ANTHONY PADEN, Defendant.
Plaintiff, ROSEMARY T. KOKUHILWA, residing at 2116 Sterling Blvd, Englewood, NJ 07631, states as follows:
1. Plaintiff and Defendant were lawfully married on February 3, 2003, in Hawthorne, New Jersey.
2. There are no children born of the marriage, and none are expected.
3. Plaintiff has continued to reside in Bergen County, New Jersey.
4. Shortly after the marriage, Defendant abandoned Plaintiff and the marital relationship. Plaintiff has had no contact with Defendant since 2003.
5. Plaintiff later learned that Defendant was incarcerated on unrelated criminal charges. Plaintiff does not know Defendant's current whereabouts or whether he is still incarcerated, but Defendant has willfully deserted Plaintiff and never attempted to resume the marital relationship.
6. Defendant's abandonment of Plaintiff has continued for well over twelve (12) consecutive months, without justification and with no reasonable expectation of reconciliation.
7. Plaintiff has kept her maiden name and does not request a name change.
