TAKE NOTICE that on the 18th day of June, 2026, a hearing will be held at 6:00pm before the Borough of Rutherford Planning Board for the Board to reconsider its denial of the Applicants subdivision application heard on February 19, 2026 to subdivide the existing lot (104.41 feet by 100 feet) into two lots, proposed lot one would be 54.41 feet by 100 feet and proposed lot two would be 50 feet by 100 feet for the property known as 124 Fairview Avenue, Block 49, Lots 1 & 2, Rutherford, New Jersey which property is located in the R-1 District (Residential – Single Family). There is an existing one family dwelling which will remain on proposed lot one and a new one family dwelling will be constructed on the new proposed subdivided lot. The proposed one family dwelling will be built within the building envelope and comply with the zoning requirements. Applicant wishes to clarify and modify the original application to only seek a "C" variance for existing minimum side yard setback for proposed lot one (5ft/15ft required and 5ft/10.14 ft proposed/existing, corner lot) and design waiver for number of stories for the existing one family dwelling and any other relief as the Board deems just and necessary. The following clarifications and modifications were made to the original application for the Board's consideration: the existing two car garage will be reduced in size to an one car garage hereby reducing the building coverage from approximately 33.6% to 29.1%, the reduction of the size of the garage will eliminate any rear yard setback variance, the impervious coverage calculation was revised and conforms to the zoning requirement, the installation of a seepage pit for drainage and any encroachments affecting proposed Lot 2 would be removed and the newly created Lot would fully conform with the zoning requirements for the R-1 district.
The Planning Board will hear this appeal at 6:00pm on June 18, 2026, the second floor of Borough Hall, 176 Park Avenue, Rutherford, New Jersey. Members of the public may appear and present any objection or evidence relating to this appeal. Documents relating to this application may be viewed at Borough Hall by appointment.
