ORDINANCE NO. 2028-0726
AN ORDINANCE OF THE COUNCIL OF THE CITY OF AVONDALE, ARIZONA, ABANDONING A PORTION OF RIGHT OF WAY RUNNING ALONG PARK AVENUE GENERALLY LOCATED SOUTH OF NORTH ROOSEVELT STREET AND EAST OF NORTH AVONDALE BOULEVARD, IN AVONDALE, ARIZONA.
WHEREAS, Article I, Section 3 of the Avondale City Charter authorizes the City of Avondale (the "City") to dispose of its acquired property as the City's interests may require; and
WHEREAS, the Council of the City of Avondale (the "City Council") approved the Final Plat for Avondale City Center Phase 3 on October 7, 2013, which created Lots A, B, and C, dedicated 88 feet of public right-of-way and which was recorded in Book of Maps 1163, Page 43, of the Maricopa County Recorder's Office (the "Recorded Plat"); and
WHEREAS, the Recorded Plat dedicated a 44-foot half street right-of-way along Park Avenue adjacent to the property identified as Lot B (the "ROW");
WHEREAS, the City Council has determined a portion of the ROW, approximately
+ 0.150 acres, is no longer necessary for public use (the "Abandoned ROW"), and the City Council desires to abandon the Abandoned ROW pursuant to Ariz. Rev. Stat. §9-240(B)(3)(e) and Ariz. Rev. Stat. § 28-7205.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF AVONDALE as follows:
SECTION 1. The recitals above are hereby incorporated as if fully set forth herein.
SECTION 2. The Abandoned ROW, as more particularly described and depicted in Exhibit A, attached hereto and incorporated herein by reference, is hereby declared to be no longer necessary and is hereby abandoned to the adjacent property.
SECTION 3. The Mayor, the City Manager or authorized designee, the City Clerk and the City Attorney are hereby authorized and directed to take all steps and execute all documents necessary to carry out the purpose and intent of this Ordinance.
