PUBLIC HEARING NOTICE CITY OF PATERSON ZONING BOARD OF ADJUSTMENT PASSAIC COUNTY

PUBLIC HEARING NOTICE CITY OF PATERSON ZONING BOARD OF ADJUSTMENT PASSAIC COUNTY PLEASE TAKE NOTICE that on June 30, 2026, at 7:30 p.m. at the Council Chambers of the City of Paterson City Hall, 155 Market Street, Third Floor, Paterson, New Jersey 07505, the City of Paterson Zoning Board of Adjustment will hold a public special hearing on an application filed by Paterson Charter School for Science and Technology, Inc. (the "Applicant") seeking Preliminary and Final Major Site Plan approval, bulk variances, and "d(2)" Expansion of Nonconforming Use Variance relief for an existing school at 196-204 West Railway Avenue, Paterson, New Jersey 07503. Applicant proposes site security improvement to the building with its current use of an 8-12 grade school. Applicant seeks to alter and expand the pre-existing charter school. It is the Applicant's position that a "d(2)" Expansion of Nonconforming Use Variance is triggered, but in the event the Board or its professionals determine that a "d(1)" Use variance is required (or any other variance), then Applicant will request the same. The subject property (referred to herein as "the Site") is located at 196-204 West Railway Avenue, Paterson, New Jersey 07503, and identified as Block 6704, Lot 1, in the Heavy Industrial (I-2) Zoning District. Applicant proposes improvements to modernize the Site and enhance its safety. The improvements consist of a parking lot sliding entrance gate, fencing around trash enclosures, pilasters, addition of landscaped islands, entry canopy with lighting, two illuminated signs (one attached to the building and another on the façade of the building) (three new illuminated signs in total are proposed), new refuse and recycling area, and other fencing. More specifically, Applicant is seeking site improvements for security purposes which include: Along Gould Avenue • a 6 ft tall fence; • fencing around the trash enclosure; and • sliding driveway security gate Along Goshen Street • increased landscaping islands: • 6 ft tall fencing over the wall with a sliding driveway security gate; • 7.5 ft tall digital sign located inside the perimeter of the security wall; • entry canopy with lighting; • a façade sign; and • vertical sign attached to the building. The Site is currently utilized as a school (grades 8-12). The proposed use is not permitted within the I-2 District. The Applicant is the owner of a lawfully created preexisting nonconforming use, but the Applicant proposes additional accessory uses, bulk variance relief and waivers as set forth above and hereinafter including a canopy, digital bulletin board with a sign on top, internally illuminated wall sign, and two (2) double sided overhang signs which require relief pursuant to the City of Paterson's Ordinances §500-2.2c Schedules of Permitted Principal, Accessory and Conditional Use and §500-8.3c Signs Prohibited in all Districts as well as N.J.S.A. 40:55D-70(d)(2) as an expansion of a nonconforming use. The Applicant proposes a total of 74 parking spaces, inclusive of the leased parking area, whereas 75 total parking spaces currently exist and 55 parking spaces are required under the applicable ordinance. The City of Paterson and/or the Zoning Board of Adjustment has taken the position that prior the number of parking spaces is reduced by two parking spaces and that 62 parking spaces are required, 48 parking spaces were previously approved, and that the current proposal provides 46 parking spaces. To the extent determined necessary by the Zoning Board of Adjustment, the Applicant requests any and all variances, waivers, exceptions, or other relief related to the number, configuration, and provision of parking spaces. Under N.J.S.A. 40:55D-70(d)(2), an expansion of a nonconforming use variance is required. Applicant seeks, among other things, approval to install 3 illuminated signs as noted above. Under Paterson's municipal code §500-8.3c, digital signs are prohibited in all districts. Since the school is not permitted in the I-2 district, the installation of the 3 digital signs constitutes an expansion of a nonconforming use (d2) or, in the alternative, a use variance (d1). Applicant seeks such relief. Applicant also seeks bulk variance relief for the items set forth in this notice including, but not limited to, (i) dumpsters must be 10 feet to primary building and greater than 10 feet is proposed, (ii) dumpsters are not permitted in the front yard and Applicant is proposing a dumpster in the front yard, (iii) the number of required onsite parking spaces as described above, (iv) fences along the front property line cannot exceed 4' and 6' is proposed. A total of 6 variances is required, with one being a "D" variance for use. Applicant will also seek any and all additional relief identified throughout the application process, including, but not limited to, other use or bulk variances, exceptions, or waivers. The application is on the referenced Zoning Board of Adjustment's public special hearing agenda to be held on June 30, 2026, at 7:30 p.m. at the Council Chambers of the City of Paterson, City Hall, 155 Market Street, Third Floor, Paterson, New Jersey 07505. When this case is called, you may appear either in person, by agent, or by an attorney, and present any comments or objections which you may have to the granting of the relief sought in the application. Any interested party may appear at said hearing and participate therein in accordance with the rules of the City of Paterson Zoning Board of Adjustment. If you have no objections to this matter, you do not have to be present at the meeting.
