Zoning Board of Adjustment
PLEASE TAKE NOTICE:
That Nick Zukas has applied to Howell Township Zoning Board of Adjustment for plot plan and bulk variance approval to construct a two-story single-family dwelling with walkways, reconfigured driveway, a subsurface sewage disposal system, a well, and other ancillary structures and utilities on currently undeveloped property with an unimproved roadway. Applicant also seeks variance relief pursuant to NJSA 40:55D-36 from the requirements of 40:55D-35 to permit the issuance of a building permit for a single-family home on a lot which does not abut a street that has been suitably improved to municipal standards or accepted as a public right-of-way. This property is located in the R-3 zone at 0 Birch Street, Howell, NJ 07731, Howell, New Jersey, also known as Block 185, Lots 53 & 54 as shown on the official tax map of Howell Township.
The Applicant seeks the following variances and/or design waivers for relief from the following requirements:
Applicant seeks approval to construct a fully conforming single-family dwelling on a lot which currently has an unimproved roadway.
Lot Frontage on Unimproved Street – Birch Street & Woodland Avenue (§188-51A) – Every lot shall contain front, rear and side yards as required in the zone. All lots shall have a minimum of one front yard fronting on a street, as defined in N.J.S.A. 40:55D-7, which has been improved to Township standards or accepted by the Township. The Applicant proposes to improve a portion of the Birch Street ROW with an 18' ft. wide asphalt roadway extension. No improvements are proposed within the Woodland Avenue ROW.
Design waivers:
100 Ft. Stream Corridor Disturbance (§188-34B) – No permanent structures are permitted within the required 100 ft. Mink Run stream corridor whereas the proposed septic disposal field appears to be partially within the required stream corridor.
100 Ft. Stream Corridor Buffer (§188-34B) – No permanent structures are permitted within the required 100 ft. Mink Run stream corridor buffer whereas the dwelling, septic tank, recharge trench and driveway are proposed within the required stream corridor buffer.
Curb – Roadway Frontage (§188-125) – Concrete curb with gutter, or concrete curb, or Belgian Block curb shall be installed along every street whereas no curb is proposed.
Sidewalk – Roadway Frontage (§188-132) – Sidewalks shall be constructed on both sides of all proposed streets, along the entire frontage of the subject property whereas no sidewalk is proposed along the Birch Street and Woodand Avenue frontages.
The applicant may seek additional variances and/or waivers and exceptions or interpretations as required by law or Howell Township Zoning Board of Adjustment including but not limited for re-approval and/or reaffirmation of any and all other relief that may have been granted in any prior applications.
This application will be heard by Howell Township Zoning Board of Adjustment at a public meeting on March 23, 2026 in the Main Meeting Room of the Howell Township Municipal Building at 4567 Route 9 North, 2nd Floor, Howell, New Jersey 07731. The meeting will commence at 7:00 P.M. at which time you may appear either in person or by an attorney and present any objection or questions you may have to the granting of this application. The application and supporting documents of this application are on file with the Zoning Board of Adjustment Secretary and may be inspected by you during regular business hours of the Township of Howell, Department of Community Development at 4567 Route 9 North, 2nd Floor, Howell, NJ.
