PLEASE TAKE NOTICE that the Zoning Board of Appeals of the Village/Town of Mount
Kisco, New York will hold a Public Hearing on the 18th day of November, 2025 at the
Municipal Building, Mount Kisco, New York, beginning at 7:00PM pursuant to Zoning
Ordinance on the Appeal of Sindri Kinnier and Rajiv Perinbasekar, 105 Manchester
Drive, Mount Kisco, NY 10549 from the decision of Peter J. Miley, Building Inspector,
dated October 15, 2025, denying the application to permit a proposed vertical
enlargement and alteration of a detached accessory (garage) structure.
The structure is located 23.9 feet closer to the west side yard property line than the
house, where it should not be closer to the side lot line than the house. It is located 11.3
feet from the rear lot line where the required setback is 15 feet. The proposed alteration includes replacing a flat roof with a peaked roof, enlarging the structure to 26 feet, where the height is not supposed to exceed 15 feet.
The property involved is known as 105 Manchester Drive and described on the Village Tax Map as Section 80.24 Block 1 Lot 3 and is located on the south side of Manchester
Drive in RS-9 (Moderate-Density One-Family Residence) Zoning District. Said Appeal is being made to obtain a variance from the following:
Section 110-31 G. (1) of the Code of the Village/Town of Mount Kisco states that no
accessory structure shall be located or project nearer to any street line or side lot line than does the principal structure on the lot.
Section 110-31 G. (4) of the Code of the Village/Town of Mount Kisco states that an
accessory structure shall not exceed 15 feet in height.
Section 110-3 1 G. (5) of the Code of the Village/Town of Mount Kisco states that an
accessory detached garage shall not be closer than 15 ft. to a rear lot line.
Section 110-35 (D) of the Code of the Village/Town of Mount Kisco, which prohibits the enlargement of noncomplying buildings and structures.
