Memorandum of Agreement
The Maine Department of Environmental Protection (MEDEP), Petroleum Management Division is hereby providing public notice of the intent of MEDEP to enter into a Memorandum of Agreement (MOA) with Portsmouth Naval Shipyard to establish an alternative procedure to the immediate reporting of certain oil discharges of ten (10) gallons or less at their Kittery facility. Under the Memorandum of Agreement, Portsmouth Naval Shipyard will clean up any spills and maintain a log of these spills at the facility that is available to MEDEP personnel upon request. Portsmouth Naval Shipyard will also be required to send a copy of this log to MEDEP for review on an annual basis. This agreement would expire three (3) years from the signature date.
The purpose of this public notice is to initiate a thirty (30) calendar day comment period beginning on the date of publication. During this period, the public is invited to comment in writing on the proposal. The public may view a copy of the proposed Memorandum of Agreement at MEDEP's Augusta office or at the clerk's office in Kittery, Maine. A copy of the proposed Memorandum of Agreement will be mailed by the entity seeking an MOA to the clerk's office. If, after reviewing the project files, you would like to comment on the proposed Memorandum of Agreement, you should mail your comments to:

Comments must be received by the Department by 5:00 PM on 4/8/2026. A final decision regarding the proposed Memorandum of Agreement will not be made until the comment period has ended. For more information call the MEDEP at 207-287-7688.
