PUBLIC NOTICE
Solicitation of Public Comment
According to the provisions of Title 40, Code of Federal Regulations Part 403, and Tennessee Rules and Regulations 0400-40-14, the Tennessee Department of Environment and Conservation, requires public comment to be solicited where there are substantial changes to an approved Industrial Pretreatment
Program. The Smyrna Utility Department has received preliminary approval from TDEC for modifications made to the Town's Sewer Use Ordinance and is making a formal notice to the public that these changes have been made following the necessary two (2) readings by the Town Council. The public is being given the opportunity to view the changes and make written comments regarding them. The proposed changes are available for review and inspection to all interested parties in the Smyrna Utilities office located at 315 S. Lowry Street in Smyrna, TN during normal business hours for 30 days from the time of publication. Written
comments regarding the program will be accepted during this time period at city hall.
The proposed amendments to the Sewer Use Ordinance are as follows:
• Updates to outdated terms, abbreviations and definitions which are now in line with the 40 CFR and TN 0400 Rule.
• Clarification of language regarding the Town's legal authority in matters of industrial permitting approval or denial.
• Clarification of language regarding the Town's legal authority to establish and modify Local Limits as necessary to protect the POTW.
• Clarification of language with regard to the availability of confidential information to government agencies for usage including but not limited to NPDES or pretreatment programs
• Clarification of language regarding Industrial Discharge requirements and the application to all Industrial Users, not just those deemed "significant"
