PUBLIC NOTICE TO BIDDERS REGARDING SALE OF PROPERTY BY WARREN TOWNSHIP
At the June 8, 2025, special meeting of the Warren Township Board (the "Board"), the Board determined that it was appropriate to sell the real estate currently owned by the Warren Township Building Corporation upon transfer to Warren Township of St. Joseph County, Indiana (the "Township"), commonly known as 59330 Crumstown Highway, North Liberty, Indiana, the legal description of which is set forth herein below (the "Property"). The sale of the Property was approved by the Board on July 16, 2025. At the September 9, 2025, regular meeting of the Board, the Board rejected all received bids and now the Township wishes to republish notice of the sale of the Property upon revised terms. The sale of the Property shall be upon the following terms and conditions:
1. The purchase price of the Property shall be not less than Two Hundred Thousand and 00/100 Dollars ($200,000.00). The purchaser of the Property shall be responsible for paying certain additional expenses associated with the sale of same, which expenses shall include, but not limited to, the cost of the publication of notices, recording fees and other fees incurred by the Township as a result of such sale.
2. Real Estate Information Packages are available from Township Counsel, Alex C. Bowman, 4101 Edison Lakes Parkway, Suite 100, Mishawaka, Indiana 46545, abowman@kdlegal.com.
3. Interested bidders may inspect the real estate during normal business hours upon (i) written notice to the Township Trustee, Robert Kruszynski, 54837 Quince Rd., South Bend, IN 46628 (574-276-7913); and (ii) execution and delivery of a release, indemnification and hold harmless agreement available from the Township Counsel, Alex C. Bowman, 4101 Edison Lakes Parkway, Suite 100, Mishawaka, Indiana 46545, abowman@kdlegal.com. All inspections will be conducted at such bidder's expense. Inspections will be allowed through 5:00 p.m. on the day before bids are due.
4. Bids must be submitted on the form found in the Real Estate Information Package.
5. Bids will be accepted beginning September 15, 2025, and until October 14, 2025, at 12:00 pm eastern time.
6. All bids must be delivered or mailed to the Township Counsel, Alex C. Bowman, 4101 Edison Lakes Parkway, Suite 100, Mishawaka, Indiana 46545, abowman@kdlegal.com. The envelope should be clearly marked "Bid Enclosed - 59330 Crumstown Highway".
7. At the October 14, 2025, meeting of the Board, all bids received will be publicly opened. After this public opening any bidder may submit a new bid, provided that all subsequent bids shall be open to public inspection upon receipt. Additional bids will be accepted until 12:00 p.m. on November 10, 2025, and must be addressed as set out in paragraph 6 of this notice. Such subsequent bids will be announced by the Board at its next regularly scheduled meeting, currently set for November 11, 2025. The sale will continue from day to day for a period determined by the Township Trustee of not more than sixty (60) days.
8. The Property may not be sold to a person who is ineligible under Indiana Code § 36-1-11-16, and an offer to purchase the Property which is submitted by a trust as defined in Indiana Code § 30-4-1-1(a) must identify each beneficiary of the trust and the settler empowered to revoke or modify the trust.
9. The legal description of said Property is:
LOT 2 IN VINSION MINOR SUBDIVISION, AS PER PLAT THEREOF, RECORDED MAY 14, 1996 AS INSTRUMENT NO. 9618395, IN THE OFFICE OF THE RECORDER OF ST. JOSEPH COUNTY, INDIANA.
10. The Property is part of Tax Parcel No. 71-07-27-177-001.000-029.
11. The Property will be transferred "as is", "where is" and "with all faults". The Township makes no representation or warranty as to the physical condition or value of the Property.
12. The Township reserves the right to reject all bids. The Township may also, before expiration of the time set out in this notice, sell the Property to the highest and best bidder.
