SUBSTITUTE TRUSTEE'S NOTICE OF SALE
WHEREAS, on December 20, 2021, Jacqua L. Carter, a married man, and Jessica Ann Wright Carter, his wife executed a Deed of Trust to Granville Tate, Jr., Trustee for the benefit of Mortgage Electronic Registration Systems, Inc. (MERS), as recorded in the office of the Chancery Clerk of Forrest County, Mississippi, in Book 2399 at Page 595; and,
WHEREAS, on or about August 1, 2025, Trustmark National Bank, a national banking association, converted to Trustmark Bank, a Mississippi banking corporation ("Trustmark Bank"), retaining all rights, claims, and interests in and to the aforementioned Deed of Trust and the indebtedness secured thereby; and,
WHEREAS, Mortgage Electronic Registration Systems, Inc. (MERS), assigned said Deed of Trust to Trustmark Bank, successor by conversion from Trustmark National Bank, by instrument dated December 1, 2025, and recorded in Book 2611 at Page 186 of the records of the office of the Chancery Clerk of Forrest County, Mississippi; and,
WHEREAS, Trustmark Bank, successor by conversion from Trustmark National Bank, the holder of said Deed of Trust and the Note secured thereby, substituted McKay Franklin PLLC as Trustee in said Deed of Trust, as authorized by the terms thereof, by instrument dated December 19, 2025, and recorded in Book 2613 at Page 262 in the office of the aforesaid Chancery Clerk; and,
WHEREAS, default having been made in the terms and conditions of said Deed of Trust, and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said Deed of Trust, and the legal holder of said indebtedness having requested the undersigned Substitute Trustee to execute the Trust and sell said land and property in accordance with the terms of said Deed of Trust for the purpose of raising the sums due thereunder, together with attorney's fees, Substitute Trustee's fees and expenses of sale;
NOW, THEREFORE, the undersigned McKay Franklin PLLC, being the Substitute Trustee, does hereby give notice that on February 13, 2026, between 11:00 o'clock a.m. and 4:00 o'clock p.m., being the legal hours of sale, it will proceed to sell at public outcry, to the highest bidder for cash, at the northeast main entrance back door of the Paul B. Johnson, Jr., Chancery Building of the Forrest County Courthouse in Hattiesburg, State of Mississippi, the following real property described and conveyed in said Deed of Trust, lying and being situated in Forrest County, Mississippi, and being more particularly described as follows, to-wit:
Lot 21, Sharon Acres Subdivision Addition of Forrest County, a subdivision according to the map or plat thereof on file and of record in the office of the Chancery Clerk of Forrest County, Mississippi.
The undersigned will convey only such title as is vested in it as Substitute Trustee.
