SUMMARY STATEMENT OF THE OBJECT OF THE COMPLAINT AND DEMAND FOR RELIEF:This is an action for breach of contract, fraudulent misrepresentation, unjust enrichment, declaratory relief, and constructive trust. Plaintiff alleges that she loaned a total of $450,000.00 to Defendant Sun West Designs, LLC for the purchase and rehabilitation of real property in Mesa, Arizona, with the understanding that the funds would be used by that entity. Plaintiff further alleges that Defendant Anna A. Kraskoff diverted the loan proceeds to Premiere Capital, LLC (an Arizona limited liability company she solely owns and controls), failed to repay the loans when due, and that the corporate veil of Sun West Designs, LLC should be pierced to hold Defendant Kraskoff personally liable. Plaintiff seeks a money judgment against Defendant Anna A. Kraskoff in the amount of $600,505.48, plus accruing interest, costs, disbursements, and such other and further relief as the Court may deem just and proper.
