AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF PARADISE VALLEY, ARIZONA, AMENDING THE PARADISE VALLEY TOWN CODE CHAPTER 2 (MAYOR AND COUNCIL): ARTICLE 2-2 (MAYOR), SECTION 2-2-2 (VICE MAYOR), RELATING TO SELECTION OF THE VICE MAYOR, AND SECTION 2-2-7 (POWERS AND DUTIES OF THE VICE MAYOR), RELATING TO VICE MAYOR DUTIES UPON DISABILITY OF THE MAYOR; AND ARTICLE 2-6 (ORDINANCES, RESOLUTIONS AND CONTRACTS), SECTION 2-6-6 (POSTING REQUIRED), RELATING TO CONFORMING THE TOWN'S POSTING REQUIREMENTS TO CHANGES IN STATE LAW; AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED by the Mayor and Town Council of the Town of Paradise Valley, as follows:
Section 1. The Town Code, Chapter 2 (Mayor and Council), Article 2-2 (Mayor), Section 2-2-2 (Vice Mayor), is hereby amended as follows (new text is shown in bold underline):
Section 2-2-2 Vice Mayor
At the first regular meeting in January of each year, the eligible Council Member, as determined by the process below, shall be designated one of its members as Vice Mayor for a one-year term.
A. The Council Member eligible to serve as Vice Mayor shall be the longest serving Council Member who (i) has not previously served as the Vice Mayor, (ii) has served at least one year as an elected Council Member, and (iii) agrees to serve.
B. If multiple Council Members meet the requirements of Subsection A above and have the same length of service on the Council, the Council Member deemed to be the longest serving member shall be determined based upon the number of votes for the position of Council Member received by each such Council Member, calculated at the most recent election when each such Council Member was elected; the Council Member with the highest number of votes shall be deemed the longest serving.
C. If no Council Members meet the requirements of Subsection A above, and all other current Council Members have previously served as the Vice Mayor, Council Members shall be eligible to serve in the order they previously served as Vice Mayor. Any Council Member who serves as Vice Mayor pursuant to this Subsection C shall be ineligible to serve additional terms as Vice Mayor.
Section 2. The Town Code, Chapter 2 (Mayor and Council), Article 2-2 (Mayor), Section 2-2-7 (Powers and Duties of the Vice Mayor), is hereby amended as follows:
Section 2-2-7 Powers and Duties of the Vice Mayor
The powers and duties of the Vice Mayor shall include the following:
A. In the absence or disability of the Mayor, the Vice Mayor shall execute the duties of Mayor.
B. The Vice Mayor shall serve as the Council's liaison to the Planning Commission.
C. The Vice Mayor shall be responsible for coordinating the annual performance reviews for the Town Manager and Town Attorney
Section 3. The Town Code, Chapter 2 (Mayor and Council), Article 2-6 (Ordinances, Resolutions and Contracts), Section 2-6-6 (Posting Required), is hereby amended as follows:
Section 2-6-6 Posting Required
Every ordinance imposing any penalty, fine, forfeiture, or other punishment shall, after passage, be posted by the Clerk at Town Hall, on the Town's website, and by any additional public notice as is reasonable and practicable. Exhibits to the ordinance may be excluded from the postings pursuant to this section if the Clerk lists in the postings where the exhibits are available for public use and inspection. Posting may be established by the affidavit of the person who posted the ordinance filed with the Clerk.
Section 4. If any section, subsection, sentence, clause, phrase or portion of this ordinance, or of the amendments hereby adopted, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
Section 5. The Mayor, the Town Manager, the Town Clerk, and the Town Attorney are hereby authorized and directed to take all steps necessary to carry out the purpose and intent of this ordinance.
