ORDINANCE #1251-25
AN ORDINANCE TO AMEND CHAPTER 75 ENTITLED "CERTIFICATES OF COMPLIANCE" OF THE TOWNSHIP CODE OF THE TOWNSHIP OF ROCHELLE PARK, STATE OF NEW JERSEY
BE IT ORDAINED BY THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF ROCHELLE PARK IN THE COUNTY OF BERGEN AND STATE OF NEW JERSEY, AS FOLLOWS:
WHEREAS, Chapter 75 of the Code of the Township of Rochelle Park sets forth all regulations governing Certificates of Compliance in the Township of Rochelle Park; and,
BE IT ORDAINED, by the Mayor and Committee of the Township of Rochelle Park, County of Bergen and State of New Jersey that those portions of the aforesaid set forth below are hereby amended as follows and that those portions of the Ordinance not set forth below shall remain unchanged.
Ch. 75-1. Definitions
As used in this chapter, the following terms shall have the meanings indicated:
MULTIPLE DWELLING
Any building or structure containing three or more dwelling units.
RESIDENTIAL BUILDING
Includes one and two family homes, multiple family dwellings and units therein and individual condominium and cooperative units.
Sec. 75-2. Certificate of compliance.
No person shall occupy or use any portion of a commercial, industrial or residential building after such building or portion thereof has been vacated, leased or sold, or when there has been a change in use or occupancy of such building or any portion thereof, until the owner or landlord thereof shall have applied for and secured a certificate of compliance subject to the requirements of Sec. 75-3 herein. Such certificate shall be issued upon a general inspection of the visible parts of the building and the portion thereof that has been vacated, leased or sold or in which there has been a change in use and occupancy, finding that there are no imminent hazards and that the premises in question are in compliance with applicable building, health, safety and fire codes, regulations, ordinances and statutes of the Township of Rochelle Park.
Sec. 75-3. Certificate required for occupancy.
Prior to the rental, sale or lease of any residential or commercial property or the sale of any individual unit in a multiple-family dwelling involving a new occupancy or change of use or tenancy, the enforcement officer shall issue a certificate of compliance in accordance with the standards set forth in § 75- 2 of this chapter.
Sec. 75-4. Smoke detectors required in residential buildings.
No certificate of compliance may be issued to a residential building or any portion thereof unless an approved smoke detector device has been installed as required by applicable state statute and local ordinance.
Sec. 75-5. Application for certificate of compliance.
Prior to any rental, lease or sale of any building or any portion thereof, as set forth in Sec. 75-3 above, the owner thereof shall apply to the enforcement officer on an appropriate form for a certificate of compliance.
Sec. 75-6. Time limit for issuance or denial of certificate.
The enforcement officer shall conduct an inspection of said commercial, industrial or residential building, or portion thereof which is to be sold, rented or leased, within a reasonable time, not exceeding 30 days after completion of said application, and shall issue a certificate of compliance, provided that the standards set forth in Sec. 75- 2 of this chapter have been satisfied and, in the case of residential building, that the premises are in compliance with the requirement of installation of a smoke detector alarm system.
Sec. 75-7. Failure to comply.
If, after inspection by the enforcement officer, a certificate of compliance may not be issued to the commercial, industrial or residential building or portion thereof because of the existence of a violation of any code or failure to comply with the standards set forth in Sec. 75-2 of this chapter, notice shall be given by the enforcement officer to the owner detailing the violations of applicable laws, regulations or ordinance. The enforcement officer shall have the authority to issue any summons or complaint for any violation of any ordinance, statute or regulation against the owner and/or occupant of the commercial, industrial or residential building or portion thereof wherein the violation exists. In the event any violations are found to exist, there shall be no new occupancy or use of the premises until the criteria has been satisfied for the issuance of the certificate of compliance.
Sec. 75-9. Fees.
The following fees shall be applicable for the inspection and issuance of a certificate of continuing compliance:
A. For the sale of a one-family homes and individual condominiums, cooperative units and apartment units: $100.
B. For the sale of a two-family dwellings: $200
C. For multiple-family dwellings:
(1) For the first two units: $200; and
(2) For each additional unit: $50.
D. For commercial or industrial property:
(1) Less than 3,000 square feet of gross floor area: $200.
(2) Between 3,000 square feet and 10,000 square feet of gross floor area: $500.
(3) More than 10,000 square feet of gross floor area: $500, plus $25 for each 1,000 square feet.
E. For the lease of any dwelling unit within a residential building: $100.00
Severability. All provisions of this Ordinance are severable. If for any reason, any provision of this Ordinance is held to be invalid, the validity of the remainder of the Ordinance shall not be affected.
Effective Date. This Ordinance shall become effective upon final approval and publication, pursuant to law, and upon completion of all outstanding cases.
NOTICE OF INTRODUCTION
NOTICE IS HEREBY GIVEN that Ordinance #1251-25, was introduced and passed on first reading at a meeting of the Township Committee of Rochelle Park, held on November 12, 2025 and ordered published in accordance with the law. Said Ordinance will be considered for final reading and adoption at a meeting held on December 10, 2025 at 7:00 PM, in the Township of Rochelle Park Municipal Building, at which time all persons interested will be given an opportunity to be heard concerning such Ordinance.
