AN ORDINANCE TO AMEND CHAPTER 73, ARTICLE II ENTITLED
"KEEPING OF OTHER ANIMALS" OF THE TOWNSHIP CODE OF THE
TOWNSHIP OF ROCHELLE PARK, STATE OF NEW JERSEY
BE IT ORDAINED BY THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF ROCHELLE PARK IN THE COUNTY OF BERGEN AND STATE OF NEW JERSEY, AS FOLLOWS:
WHEREAS, Chapter 73, Article II of the Code of the Township of Rochelle Park sets forth all regulations regarding Keeping of Other Animals in the Township of Rochelle Park; and,
BE IT ORDAINED, by the Mayor and Township Committee of the Township of Rochelle Park, County of Bergen and State of New Jersey that those portions of the aforesaid set forth below are hereby amended as follows and that those portions of the Ordinance not set forth below shall remain unchanged.
Sec. 73-10. Feeding of Wildlife or Stray Animals.
A. Prohibited conduct.
(1) No person shall feed or attract any wild or stray animal. The definition of "wild or stray animals" shall include but not be limited to the following: cats, dogs, waterfowl, raccoons, skunks, groundhogs, pigeons and other birds. "Stray animal" shall be defined as any animal which is not licensed to a Township of Rochelle Park resident. This article shall not apply to enclosed, elevated bird feeder devices. This prohibition shall also apply to any conditions by which the feeding of animals creates a public health risk or unsanitary conditions.
(2) No person shall feed, in any public park or on any other property, public or private, within the Township of Rochelle Park, any wildlife, excluding confined wildlife (for example, wildlife confined in zoos, parks or rehabilitation centers, or unconfined wildlife at environmental education centers).
B. Enforcement.
(1) This article shall be enforced by the Police Department, the Health Department, and/or other municipal officials of the Township of Rochelle Park.
(2) Any person found to be in violation of this article shall be ordered to cease the feeding immediately.
C. Violations and penalties.
Any person(s) found to be in violation of the provisions of this article shall be subject to a fine of at least $50, but not to exceed $1,000.
Severability. All provisions of this Ordinance are severable. If for any reason, any provision of this Ordinance is held to be invalid, the validity of the remainder of the Ordinance shall not be affected.
Effective Date. This Ordinance shall become effective upon final approval and publication, pursuant to law, and upon completion of all outstanding cases.
NOTICE OF INTRODUCTION
NOTICE IS HEREBY GIVEN that Ordinance #1252-25, was introduced and passed on first reading at a meeting of the Township Committee of Rochelle Park, held on November 12, 2025 and ordered published in accordance with the law. Said Ordinance will be considered for final reading and adoption at a meeting held on December 10, 2025 at 7:00 PM, in the Township of Rochelle Park Municipal Building, at which time all persons interested will be given an opportunity to be heard concerning such Ordinance.
