ZONING BOARD OF ADJUSTMENT
LEGAL NOTICE OF HEARING
PLEASE TAKE NOTICE that Scott E. Dickerson Family LP has applied to the Zoning Board of Adjustment of Rockaway Township for Amended Preliminary and Final Site Plan Approval to relocate and utilize 5,450 sq ft for outdoor storage of vehicles, equipment and trailers in addition to the continued use as an eight (8) bay car wash and detail shop for property located off Carrel Street and designated as Block 10202, Lots 37 & 50 on the Township of Rockaway Tax Map, and located in both the B-2 Highway Business Zone and I Industrial Zone.
Applicant also seeks a d(1) use variance to permit outdoor storage as a principal use unrelated to the existing car wash and detail shop use along with ancillary bulk variances: 1) Section 54-30.63(A) which states the permitted principal uses of the Industrial Zone where the pre-existing uses of the car wash and detail shop are proposed to continue and remain; 2) Section 54-30.63(E)(2) which states the minimum front yard setback is 100 feet where the pre-existing front yard setback is 80.6 feet; 3) Section 54-29.5 which states paved areas are required to be bounded by curbs where the pre-existing paved areas are not bounded by curbs; 4) Section 54-29.15(B)(2) which states any parking area in the front yard of a nonresidential zone shall not be permitted closer than 15 feet to the front street line where the pre-existing parking area is located closer than 15 feet to the street line; 5) Section 54-29.15(B)(4) which states parking areas shall be located no closer than 30 feet to any side or rear property line where the proposed outdoor storage is closer than 30 feet to the side/rear property lines; 6) Section 54-29.10 which establishes lighting standards where the pre-existing lighting is non-conforming; 7) Section 54-29.19 which establishes landscaping and buffer standards where the pre-existing landscaping is non-conforming; 8) Section 54-30.8(D)(1) which states outdoor storage shall be permitted as an accessory use in all nonresidential zones in conjunction with the principal use conducted on the property where the proposed outdoor storage is unrelated to the existing principal use; 9) Section 54-30.8(D)(3) which states outdoor storage shall be set back a minimum of 25 feet from all property lines where the proposed outdoor storage is closer than 25 feet to the property lines; 10) Section 54-30.8(D)(4) which states a barrier shall be erected along the storage setback line to prevent encroachment by storage material where the proposed outdoor storage does not have a barrier; 11) Section 54-30.8(D)(6) which states all outdoor storage shall be screened from adjoining properties and streets by means of fencing and landscaping where the proposed outdoor storage does not have immediate fencing or landscaping; 12) Section 54-30.8(D)(10) which states the outdoor storage of unlicensed, unregistered and inoperable vehicles shall not be permitted where the proposed outdoor storage does contain unlicensed, unregistered and/or inoperable vehicles, equipment and trailers; and 13) Section 54-30.8(D)(2) which states outdoor storage must be located to the rear of the principal building to which it is accessory where the proposed outdoor storage is located in front of the principal building to which it is not an accessory. The Applicant also requests such other variances, waivers, permits, approvals or licenses that are deemed necessary or appropriate by the Board.
A public hearing will be held on October 7, 2025 at 7:00 P.M. at the Rockaway Township Municipal Building, located at 65 Mount Hope Road, Rockaway, New Jersey 07866. All persons interested in said application may appear in person, or by agent or attorney, to participate in the meeting and present any objections that they may have to the granting of the relief sought and/or to provide public comment at the appropriate time.
Plans and other documentation relating to this application will be on file and available for public inspection at least ten (10) days before the hearing during normal business hours, 8:30 AM to 4:30 PM Monday through Friday, in the office of the Planning Department located in the Rockaway Township Municipal Building, 65 Mount Hope Road, Rockaway, New Jersey 07866.
