TRUSTEE'S NOTICE OF SALE
WHEREAS, on February 8, 2019, DADAJI, Inc., by and through its Secretary, Nirav P. Patel, executed a Deed of Trust to Dennis Ammann, as Trustee for Peoples Bank, as Beneficiary, which is recorded in the office of the Chancery Clerk of Madison County, MS, in Book 3690 at Page 865, Instrument # 858432;
WHEREAS, on May 14, 2025, Peoples Bank substituted James Eldred Renfroe as Trustee in the aforementioned deed of trust with this recorded in Book T-4556 at Page 141, Instrument # 1027703;
WHEREAS, there being a default in the terms and conditions of the Deed of Trust and entire debt secured having been declared to be due and payable in accordance with its terms, Peoples Bank, the holder of the debt has requested the Trustee to execute the trust and sell said land and property pursuant to its terms in order to raise the sums due, with attorney's and trustee's fees, and expenses of sale;
NOW, THEREFORE, I, James Eldred Renfroe, Trustee for said Deed of Trust, will on August 7, 2026, offer for sale at public outcry, and sell within legal hours (being between the hours of 11:00 a.m., and 4:00 p.m.) at the main front door of the Madison County Courthouse B located at 229 North Union Street, Canton MS, to the highest and best bidder for cash, the following described property situated in Madison County, MS, to-wit:
Parcel 1:
A certain parcel of land situated in the SW 1/4 of the SW 1/4 of Section 23, T9N, R2E, Madison County, Mississippi, more particularly described as follows:
Commencing at the southwest corner of that certain land conveyed to Rainbow Development, Inc., by Susan B. Anton in that certain deed dated September 2, 1982, and recorded in Book 183 at Page 221 of the land deed records of Madison County, Mississippi, and from the point of beginning run southerly along the East margin of the Soldier Colony Road a distance of 200 feet; thence leaving said road run north 85 degrees 31 minutes East a distance of 350 feet; thence northerly along a line parallel with the said East margin of the Soldier Colony Road a distance of 200 feet to a point which is North 65 degrees 31 minutes East a distance of 350 feet from the point of beginning; thence run South 65 degrees 31 minutes West 350 feet to the point of beginning, all lying and being in Section 23, Township 9 North, Range 2 East, Madison County, Mississippi.
LESS AND EXCEPT:
A part or parcel of land of Section 13, Township 9 North, Range 2 East, Madison County, Mississippi, being more particularly described as follows:
Commencing at a point which is 350 feet South 0̊40' E along the East ROW line of Soldier Colony Road from point of intersection of the South ROW line of Mississippi State Highway 22 and the East ROW line of said Soldier Colony Road, run thence North 65̊31' E for 176 feet to the point of beginning, run thence North 65̊31' E for 30 feet; run thence South 24̊29' E for 30 feet, run thence South 65̊31' W for 30 feet; run thence North 24̊29' W for 30 feet to the Point of Beginning and being situated in the SE 1/4 SW 1/4 Section 23, Township 9 North, Range 2 East, Madison County, Mississippi.
Parcel 1 being the same property as described in Warranty Deed recorded in Book 1704 at Page 217.
Parcel 2:
A lot or parcel of land lying and being situated in the SW 1/4 of SW 1/4 of Section 23, Township 9 North, Range 2 East, Madison County, Mississippi and being more particularly described as follows:
Commencing at the SW corner of the Texaco, Inc., property conveyed by deed recorded in Book 179 at Page 633 in the records of the Chancery Clerk of said County (said point commencement being on the North right of way line of Mississippi Highway 22 and also being 956 feet North and 8 feet East of the SW corner of the SE 1/4 SW 1/4 of said Section 23 according to said Texaco, Inc., deed); thence South 07̊07'51" West for 236.10 feet to a concrete fence post on the East right-of-way line of Interstate Highway No. 55 and being the approximate intersection of the East right-of-way line of Interstate 55 and the west margin of Soldier Colony Road. From said point travel 313 feet along the West right-of-way line of Soldier Colony Road to the point of beginning. From said point travel South 180 feet along the West right-of-way line of Soldier Colony Road to a point; thence travel West 96 feet to a point on the East right-of-way line of Interstate 55; thence travel Northward approximately 190 feet along the East right-of-way line of Interstate 55 to a point; thence travel East 78 feet back to a point on the west margin of Soldier Colony Road, being the point of beginning.
Parcel 2 being the same property as described in Warranty Deed recorded in Book 541 at Page 310.
I will convey only such title as is vested in me as Trustee, with no warranties.
