Pursuant to the terms of a deed of trust dated May 29, 2018, in the original principal amount of $54,985.00, recorded in the Clerk's Office of the Circuit Court of the City of Petersburg, Virginia, as Instrument No. 180001310, as assigned to Noteholder by Assignment of Deed of Trust recorded on March 9, 2026 as Instrument No. 202600956, the property briefly described below will be offered for sale at public auction:
All that certain lot or parcel of land, with the improvements thereon and appurtenances thereunto belonging, lying and being situate in the City of Petersburg, Virginia, on the east side of Patterson Street, and being the southwest corner of a certain seven (7) acre tract of land conveyed to J. R. Gresham, Sr., by Deed dated May 2, 1945, from Bertha L. Beasley and husband, recorded in the Clerk's Office of the Circuit Court of said City, in Deed Book 152, page 246, and described as follows: Beginning at a point on the east side of Patterson Street, which is a distance of 578.5 feet from the property owned by the City of Petersburg, known as the Poor House Tract; running along east side of Patterson Street in a northerly direction a distance of fifty (50) feet and extending back there from between parallel lines 125 feet and being part of the seven (7) acre tract herein above mentioned, said property designated by current city street number 1135 Patterson Street.
The sale will take place on July 6, 2026, at 1:00 p.m., at the front entrance to the building housing the Circuit Court of the County of Petersburg, located at 7 Courthouse Avenue, Petersburg VA 23803. The undersigned reserves the right to suspend bidding and/or to adjourn the bidding prior to the completion of sale.
The property and the improvements thereon will be sold "AS IS" and without representation or warranties of any kind. The sale is subject to all liens, encumbrances, conditions, easements and restrictions, if any, superior to the mentioned deed of trust and lawfully affecting the property.
Terms: A deposit in the form of CERTIFIED FUNDS in the amount of $10,000.00 (CASH NOT ACCEPTED) or 10% of the successful bid, whichever is lower, is required of any bidder at the time of sale. Closing within fifteen (15) days of sale. If the payment of the balance does not occur within fifteen days of sale, the deposit shall be retained by the Trustee as liquidated damages. Time is of the essence. Trustee has no duty to obtain possession for purchaser. The risk of loss or damage to the property passes to the purchaser immediately upon conclusion of the Substitute Trustee's sale. Purchaser to pay all closing costs, including cost of Trustee's Deed. Sale subject to lender confirmation. The Trustee may file IRS Form 8300, and a successful bidder shall provide all required information and produce a Government Picture Identification Card.
