Pursuant to the terms of a deed of trust dated February 17, 2023, in the original principal amount of $255,192.00, recorded in the Clerk's Office of the Circuit Court of the City of Petersburg, Virginia, as Instrument No. 202300569, and as modified by Loan Modification Agreement recorded on October 21, 2024, as Instrument No. 202403701, and as assigned to Noteholder by Assignment of Deed of Trust recorded on March 9, 2026, as Instrument No. 202600958, the property briefly described below will be offered for sale at public auction:
ALL those two certain lots or parcels of land, lying and being and situate in the City of Petersburg, Virginia, in the Section annexed from Prince George County, Virginia in the year 1945, and being known, numbered and designated as Lot Nos. Seventeen (17) and Eighteen (18), in Block 62 on a plat of Walnut Hill Addition, made by ER, McKesson, C.P.F., which is recorded in the Clerk's Office of the Circuit Court of Prince George County, Virginia, in Plat Book 5 at page 47, a copy of the same being also recorded in the Clerk's Office of Husting Court, of Petersburg, Virginia.
The sale will take place on July 6, 2026, at 1:00 p.m., at the front entrance to the building housing the Circuit Court of the City of Petersburg, located at 7 Courthouse Avenue, Petersburg VA 23803. The undersigned reserves the right to suspend bidding and/or to adjourn the bidding prior to the completion of sale.
The property and the improvements thereon will be sold "AS IS" and without representation or warranties of any kind. The sale is subject to all liens, encumbrances, conditions, easements and restrictions, if any, superior to the mentioned deed of trust and lawfully affecting the property.
Terms: A deposit in the form of CERTIFIED FUNDS in the amount of $10,000.00 (CASH NOT ACCEPTED) or 10% of the successful bid, whichever is lower, is required of any bidder at the time of sale. Closing within fifteen (15) days of sale. If the payment of the balance does not occur within fifteen days of sale, the deposit shall be retained by the Trustee as liquidated damages. Time is of the essence. Trustee has no duty to obtain possession for purchaser. The risk of loss or damage to the property passes to the purchaser immediately upon conclusion of the Substitute Trustee's sale. Purchaser to pay all closing costs, including cost of Trustee's Deed. Sale subject to lender confirmation. The Trustee may file IRS Form 8300, and a successful bidder shall provide all required information and produce a Government Picture Identification Card.
