Legal Notice of 45-Day Opportunity to Object for Pegasus Mineral Exploration Project
The Austin-Tonopah Ranger District of the Humboldt-Toiyabe National Forest has prepared a Final Environmental Assessment and Draft Finding of No Significant Impact for the Pegasus Exploration Project submitted by Kinross Gold USA, Inc. This project is a non-HFRA mineral exploration-only Plan of Operations located approximately three miles north of the town of Manhattan, Nevada. The proposed action consists of a ten-year operating period with maximum surface disturbance of 140.1 acres for all exploration activities. The initial phase consists of 83.2 acres of exploration disturbance with up to an additional 56.9 acres of disturbance in subsequent exploration phase(s). Exploration activities include overland travel, temporary road construction, exploratory drilling from constructed drill pads, and temporary laydown/staging areas.
The proposed Project is subject to the pre-decisional objection process pursuant to 36 CFR 218 Subparts A and B. Eligibility to File Objections
Objections can be accepted only from individuals and entities who have submitted timely, specific written comments regarding a proposed project or activity subject to these regulations during any designated opportunity for public comment, per the regulations at 36 CFR 218.5(a). Additional eligibilities are established in 36 CFR 218.5(b) through (f). Issues raised in objections must be based on previously submitted timely, specific, written comments regarding the proposed project and a connection to previous comments must be demonstrated in the objection, unless based on new information arising after designated opportunities for comment.
Individual members of organizations must have submitted their own comments to meet the requirements of eligibility as an individual. Objections received on behalf of an organization are considered as those of the organization only. If an objection is submitted on behalf of a number of individuals or organizations, each individual or organization listed must meet the eligibility requirement of having previously submitted comments on the project (36 CFR 218.5).
Objections received in response to this solicitation, including names and addresses of those who object, will be considered part of the public record on these proposed actions and will be available for public inspection during and after the objection process.
Contents of an Objection
Incorporation of documents by reference in the objection is permitted only as provided for at 36 CFR 218.8(b). Minimum content requirements of an objection as identified in 36 CFR 218.8(d) include: Objector's name and address with a telephone number if available; with signature or other verification of authorship supplied upon request.Identification of the lead objector when multiple names are listed, along with verification upon request.Name of project, name and title of the responsible official, national forest/ranger district where project is located. A description of those aspects of the proposed project addressed by the objection, including specific issues related to the proposed project; if applicable, how the objector believes the environmental analysis or draft Finding of No Significant Impact specifically violates law, regulation, or policy; suggested remedies that would resolve the objection; supporting reasons for the Reviewing Officer to consider; andA statement demonstrating the connection between prior specific written comments on this project and the content of the objection, unless the objection issue arose after the designated opportunities for comment.
Filing an Objection
Written objections, including attachments, must be filed with: Objection Reviewing Official Jon Stansfield, Forest Supervisor, Humboldt-Toiyabe National Forest, Supervisor's Office, 1200 Franklin Way, Sparks, NV 89431. The preferred method for submitting objections is electronically via the following link: https://cara.fs2c.usda.gov/Public/CommentInput?Project=68901 Electronic objections must be submitted in a format such as Portable Document Format (pdf), plain text (.txt), or Word (.doc or .docx) and electronic file names must be less than 85 characters long (including spaces). Hand delivery of written objections can be made during normal business hours from 8 a.m. to 4:30 p.m., Monday through Friday, excluding federal holidays. If sent via postal mail, mark the envelope "Attn: Kinross Pegasus Exploration Project Objection."
Objections must be postmarked or submitted electronically or by hand within 45 days following the publication of this legal notice. The publication date in the Reno Gazette-Journal newspaper of record is the exclusive means for calculating the time to file an objection to this Project. Those wishing to object to the Draft Finding of No Significant Impact should not rely upon dates or timeframe information provided by any other source.
