Legal Notice of 30-Day Public Comment Period for Burnt Rock Exploration Project
The Bridgeport Ranger District has prepared a draft Environmental Assessment (EA) for the Burnt Rock Exploration Project submitted by CP Resources Corporation. This project is a non-HFRA 10-year mineral exploration-only Plan of Operations project located approximately 23 miles west-southwest of Hawthorne, Nevada. The Proposed Action includes the construction of drill pads with sumps, temporary roads, laydown areas, widening of existing roads, and overland travel for a maximum of 250 acres of total disturbance over the 10-year life of the Project. Interim reclamation practices would be used over the life of the Project and drill pads, roads, and laydown areas would be fully reclaimed when no longer needed for the Project or when the Project is complete. The Proposed Action incorporates Environmental Protection Measures and Best Management Practices to minimize adverse environmental impacts. CP Resources would conduct seasonal exploration drilling activities as weather and seasonal wildlife restrictions permit.
The initial exploration drilling activities include the construction of 266 new drill sites, construction and maintenance of a maximum of 28 miles of new temporary access road, and construction of four laydown areas for a total of 121 acres of new surface disturbance. Future drilling programs would include up to 129 acres with the total disturbance of the Project not to exceed 250 acres for the life of the Project, including a maximum of 600 drill pads, eight laydown areas, and 45 miles of new temporary road.
Reclamation would consist of removing all equipment and materials, abandoning all boreholes, backfilling sumps, ripping and recontouring all constructed roads, drill pads, sumps and reseeding all disturbed areas with an approved seed mix. Solicitation of Comments, Comment Process, and Timeframe for Submission of Comments
The USFS is now seeking public comments for the 30-Day Public Comment Period. The purpose for this comment period is to provide opportunity for public participation prior to a decision by the Responsible Official. Submission of comments during this period is required to establish objection eligibility subject to 36 CFR 218 subparts (a) and (b). The final Finding of No Significant Impact (FONSI) will not be made until after the requirements of 36 CFR 218.12 have been met.
This project is initiating public comment after the publication of the proposed amendment to the regulations at 36 CFR 218 in the federal register on February 6, 2026 (91 FR 5387). This project and the associated EA and FONSI may be subject to the revised objection process if the final 36 CFR 218 rule is published before the project's objection period is initiated. Otherwise, this project will follow the objection process established prior to the proposed rule.
Eligibility to Provide Comments
Comments will be accepted only from individuals and entities who have submitted timely, specific written comments regarding a proposed project or activity per 36 CFR 218. Individual members of organizations must have submitted their own comments to meet the requirements of eligibility as an individual. Comments received on behalf of an organization are considered as those of the organization only. Comments will become part of the public record. Names and addresses of commentors will become part of the public record.
Contents of a Comment
Minimum content requirements of a comment as identified in 36 CFR 218 must include: (1) Name and postal address, email address in addition is recommended but not required; (2) Title of the proposed project or activity; (3) Specific written comments as defined in 36 CFR 218.2 regarding the proposed project or activity, along with supporting reasons; (4) Signature or other verification of identity upon request and identification of the individual or entity who authored the comment(s). For comments listing multiple entities or multiple individuals, a signature or other means of verification must be provided for the individual authorized to represent each entity and for each individual in the case of multiple names. A scanned signature or other means of verifying the identity of the individual or entity representative may be used for electronically submitted comments; (5) Individual members of an entity must submit their own comments to establish personal eligibility; comments received on behalf of an entity are considered as those of the entity only.
Incorporation of documents by reference in the comment is permitted only as provided for at 36 CFR 218.
Providing a Comment
Comments must be postmarked (if sent via postal mail), faxed, or submitted electronically within 30 days following publication of the legal notice in the Reno Gazette-Journal. Mailed comments should be sent to District Ranger, Burnt Rock Exploration Project, USDA Forest Service, HC 62 Box 1000, Bridgeport, CA 93517. Electronic comments can be submitted using the project webpage at: https://www.fs.usda.gov/r04/humboldt-toiyabe/projects/69000. Hand delivery of written comments can be made during normal working hours to the Bridgeport Ranger Station, 75694 US 395, Bridgeport, CA 93517. It is the responsibility of all individuals and organizations to ensure that their comments are received in a timely manner as provided for in 36 CFR 218.25(a)(4).
