ORDINANCE NO. 440
AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP AND CHAPTER 167 OF THE CODE OF ORDINANCES OF THE CITY OF GRANGER, IOWA, AS AMENDED, BY AMENDING SECTION 167.18 – BEAVER CREEK ESTATES PLANNED UNIT DEVELOPMENT.
BE IT ENACTED by the City Council of the City of Granger, Iowa, that:
SECTION 1. Purpose. The purpose of this Ordinance is to amend Section 167.18 of the Granger Code of Ordiancnes for the Beaver Creek Estates Planned Unit Development; and for other purposes.
SECTION 2. Facts Found. The Council of the City of Granger, Iowa, hereby makes the following findings:
1. After a public hearing on the 1st day of April, 2026, the Plan and Zoning Commission recommended to the Council that certain amendments be made to Section 167.18 Beaver Creek Estates Planned Unit Development.
2. Notice of the public hearing by the City Council was published in the Dallas County News, a newspaper of general circulation in the City of Granger, Iowa.
SECTION 3. Chapter 167 of the Code of Ordinances of the City of Granger, Iowa, as amended, as follows:
167.18 BEAVER CREEK ESTATES PLANNED UNIT DEVELOPMENT. Beaver Creek Estates Planned Unit Development of the Code of Ordinances is amended and approved as of the effective date of this ordinance pursuant to Section 167.11 of the Zoning Code, and the Official Zoning Map is hereby amended accordingly as provided in Section 165.05 of this Zoning Code.
1. Section 167.18 3.C is deleted and the following is substituted:
C. Parcel 3. The underlying zoning district regulations applicable for this parcel are R-1. The specific regulations for Parcel 3 are:
i. Principal Permitted Use – Single Family Dwelling
ii. Lot area: 1.00 acres
iii. Lot frontage: 100 feet
iv. Side yard: Least width any side 10 feet
v. Minimum width for both sides: 20 feet
vi. Front yard depth: 40 feet
vii. Rear yard depth: 30 feet
viii. In Parcel 3 the area of the adjoining outlot can be used to determine the adequacy of the rear yard setback.
D. Parcel 4. The underlying zoning district regulations applicable for this parcel are R-1. The specific regulations for Parcel 4 are:
i. Principal Permitted Use – Single Family Dwelling
ii. Lot area: 1.00 acres
iii. Lot frontage: Minimum of 100 feet as measured along any public street or approved common access drive
iv. Side yard: Least width any side 10 feet
v. Minimum width for both sides: 20 feet
vi. Front yard depth: 40 feet
vii. Rear yard depth: 30 feet
viii. No frontage on public street required
ix. Private access drives allowed with approved agreement for operation, maintenance, repair and replacement
x. Lot 56 allowed to have 0' yard along common lot line with Lot 57A.
E. Parcel 5. The underlying zoning district regulations applicable for this parcel are C-1. The specific regulations for Parcel 5 are:
i. No residential uses allowed
ii. Minimum lot size: 10,000 SF
2. Section 167.18 (4.)is amended to read as follows:
4. In Parcels 1, 2, 3, and 4 outlots adjoining designated lots are allowed. The minimum area of a lot is the combined area of the lot and adjoining outlot. The final plat must clearly note all outlots in Parcels 1, 2, 3, and 4 are to be tied to the adjoining developable lot.
3. Section 167.18 (6.) is amended to read as follows:
6. No private streets are allowed in Parcel 1, Parcel 2, Parcel 3 and Parcel 5. A private street or approved private joint access drive allowed in Parcel 4 in conformance with the requirements of 167.18 3,D..
SECTION 4. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed.
SECTION 5. Severability Clause. If any section, provision or part of this Ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
SECTION6 . When Effective. This Ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
