PLEASE TAKE NOTICE that the Zoning Board of Adjustment of the Township of Neptune (“Board”) will hold a virtual/remote public hearing on Wednesday, March 4, 2026 at 7:00 p.m. to consider the application of Hilmar Perez-Guzman (“Applicant”) for premises known as Lot 15 in Block 1904 as shown on the Official Tax Map of the Township of Neptune and located at 618 Wayside Road, Neptune, New Jersey (“Property”).
This meeting is being held virtually/remotely via ZOOM. You are hereby notified that you are invited to participate in this remote hearing and present any and all comments you may have to the granting of said approvals. Instructions on how to access the meeting via ZOOM are listed below.

PUBLIC PARTICIPATION IN ZOOM MEETING:
At the direction of the Board Chairman, you will be permitted to participate during the public portion of the hearing, either by asking questions and/or cross examining the witnesses or making a statement when the Applicant concludes its case. The Board Chairman will limit public comments to 5 minutes per person. If you have any questions for the Applicant or its professionals prepared in advance, please email them to the Board Secretary at hkepler@neptunetownship.org prior to the meeting. Your question(s) will be read into the record and answered. If you have information or exhibits you wish to be considered and entered into the record, you must email them to the Board Secretary at hkepler@neptunetownship.org in advance of the meeting so they may be marked into evidence. For those who are in opposition of the application, you have the right to obtain an attorney to represent you, although this is not a requirement.

THE APPLICATION:
The Property, which is located in the Township’s R-2 Low Density Residential Zone District (“R-2 Zone”), currently contains the remains of a previously existing, 1-½ story frame dwelling, partially constructed building foundations for previously approved new proposed front and rear additions, a detached garage, and concrete driveway. The Property and structures are/were preexisting nonconforming as to: lot width; lot frontage; dwelling side yard (north) setback; dwelling combined side yard setback; and, garage side yard (south) setback.
Applicant previously received zoning and building permit approval to renovate, reconstruct, and construct additions to the previously existing dwelling including: new second-floor addition over footprint of dwelling’s existing first-floor; construction of 2-story addition in front with covered porch and steps; construction of 2-story addition in rear with patio and steps; and, chimney. Applicant was further approved to remove a previously existing, nonconforming shed and related site improvements. During the course of construction more than 50% of the original pre-existing structure was demolished, resulting in a stop work order which requires variance approvals in order to recommence work. The resultant structure will be in the same footprint as previously approved and will appear identical to exterior. The difference will be new construction of portions of the building that were supposed to remain. In conjunction with the application, Applicant seeks bulk variance relief pursuant to N.J.S.A. 40:55D-70.c as follows:
• Lot width of 64.6 feet, whereas a minimum of 100 feet is required and 64.6 feet exists.
• Lot frontage of 73.3 feet, whereas a minimum of 100 feet is required and 73.3 feet exists.
• Dwelling side yard (north) setback of 3.7 feet, whereas a minimum of 10 feet is required and 3.7 feet previously existed to the first floor.
• Dwelling combined side yard setback of 18 feet, whereas a minimum of 25 feet is required and 18 feet previously existed to the first floor.
Applicant also expressly makes application for any additional exceptions, waivers, variances, interpretations and other approvals as reflected on the filed plans (as same may be further amended from time to time without further notice) and as may be determined to be necessary by the Board during the review and processing of the application.
PLEASE TAKE FURTHER NOTICE that you are invited to attend this virtual/remote public hearing either by web conference or telephone as outlined above to present any and all comments you may have to the granting of said approvals. The hearing may be continued without further notice on such additional or other dates as the Board may determine. The application and supporting documents are on file in the office of the Board located at 25 Neptune Boulevard, Neptune, New Jersey and are available for inspection as outlined above.
