LEGAL NOTICE TOWNSHIP OF JACKSON   PLEASE TAKE NOTICE that Brookwood Enterprise LLC D/B/A Cocoon Daycare (“Applicant”) has applied to the Jackson Township Planning Board seeking preliminary and final major site plan approval with design waivers to construct a new two-story child care center on property located at 33 South New Prospect Road, and designated as Block 5902, Lot 53 on the tax maps of Jackson Township (“Property”). The Property is currently developed with a single-family residence and commercial building on an approximately 1.92 acre lot, in the NC (Neighborhood Commercial) Zone (“NC Zone”), most recently used as a veterinary hospital, along with related accessory structures and site improvements, all of which will be removed. Pursuant to N.J.S.A. 40:55D-66.6, a child care center is a permitted use in all nonresidential zoning districts of a municipality, and since the NC Zone is a nonresidential district, the proposed child care center is a permitted use. The proposed development will include a two-story single structure with a basement used as part of the childcare center consisting of approximately 32,955 gross square feet, and related site improvements including parking, landscaping, fencing, and lighting. The Applicant is seeking the following relief:   1. Preliminary and final major site plan approval.   2. Design waivers from Ordinance Sections 244-196(A), 244-196(D), and 244-197(J)(2)(a)(2)(a)-(c), with respect to (1) minimum number of required truck standing, loading, and unloading spaces, whereas none are proposed, (2) the requirement that loading areas shall not conflict with parking space access, where same is proposed, (3) minimum distance of entrance drives from the parking access aisle, (4) minimum distance of exit drives from the parking access aisle, and (5) no parking stalls shall utilize the required major circulation drives as parking access aisles, whereas the parking accesses the main circulation drive, respectively.   3.
