ORDINANCE 2026-02 BOROUGH of FARMINGDALE, COUNTY OF MONMOUTH
AN ORDINANCE PROVIDING FOR REVISED CHAPTER 27, AFFORDABLE HOUSING REGULATIONS AND DEVELOPMENT FEES, OF THE CODE OF THE BOROUGH OF FARMINGDALE, COUNTY OF MONMOUTH AND STATE OF NEW JERSEY
This ordinance summary published herewith was introduced and passed upon first reading at a meeting of the Mayor and Borough Council of the Borough of Farmingdale, in the County of Monmouth, New Jersey, held February 17, 2026. It will be further considered for passage and final adoption after public hearing thereon, at a meeting of said Mayor and Borough Council to be held at the Borough Community Center, 13 Asbury Avenue, Farmingdale, NJ on Tuesday, March 3, 2026 at 6:00 p.m. Copies of said ordinance will be made available at the Clerk's Office in the Farmingdale Municipal Building to the members of the general public during regular business hours. Ordinance 2026-02 amends the Farmingdale Borough Code Chapter XXVII in its entirety to include updated provisions addressing very low-, low- and moderate-income housing and implements and incorporates the relevant provisions of the Borough's Housing Plan Element And Fair Share Plan and addresses the requirements of P.L 2024, Chapter 2, the FHA, N.J.A.C. 5:99, NJ Supreme Court upheld COAH regulations at N.J.A.C. 5:93 and 5:97, and UHAC at N.J.A.C. 5:80-26.1. This Ordinance is intended to ensure that very low-, low- and moderate-income units ("affordable units") are created with controls on affordability over time and that very low-, low- and moderate-income households shall occupy these units pursuant to statutory requirements. This Ordinance shall apply to all inclusionary developments, individual affordable units, and 100% affordable housing developments except where inconsistent with applicable law. This ordinance also specifies how affordable units are to be phased with market rate housing units, income eligibility standards, control periods for affordability, occupancy standards, affordability enforcement, and responsibilities of the Municipal Housing Liaison and designated Affordable Housing Agent. This ordinance is designed to implement the Farmingdale Borough Housing Plan adopted by the Borough Planning Board on February 23, 2026 and endorsed by the Borough Council on March 3, 2026. The Affordable Housing Ordinance is required due to the Borough's participation in the Affordable Housing Dispute Resolution Program, and its settlement with Fair Share Housing Center, and the recommendations of the Program Judge, which culminated in an entry of an Order from the Vicinage Mount Laurel Judge.
