SALE UNDER POWER
State of Georgia,
County of Richmond.
Under and by virtue of the Power of Sale contained in a Security Deed given by 4 T’s Investments, LLC to Irene Marie Ortega, dated July 15, 2021, as recorded in the Office of the Clerk of Superior Court of Richmond County, Georgia, in Deed Book 1792, at page 564, conveying the after-described property to secure a Note of even date in the original principal amount of $145,500.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of Richmond County, Georgia, within the legal hours of sale on the first Tuesday in March, 2026, to wit: March 3, 2026, the following described property:
ALL THAT LOT OR PARCEL OF LAND, with improvements thereon, situate, lying and being in the State of Georgia, County of Richmond, being known and designated as Lot 8, Block A, Creek View West Subdivision as shown on a plat recorded in the Office of the Clerk of Superior Court of Richmond County, Georgia, in Realty Reel 154, page 1256-1263. Reference is hereby made to said plat for a more complete and accurate description as to the metes, bounds and location of said property.
Said property is conveyed subject to and with notice of the following matters: a) drainage easements, building setback lines, and all other matters shown on the record plat; b) general utility easements and road right-of-way grants and easements.
Said property is conveyed subject to easements recorded in Book 155, page 1616 and Book 156, page 1068 and Deed of Dedication recorded in Book 158, page 2533 and Book 177, page 2108 and to Restrictive Covenants recorded in said Clerk’s Office in Realty eel 14, page 1264, and to any and all restrictions and easements of record.
The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and other specific breaches of covenants contained in said Note in the manner provided in the Note and Deed to Secure Debt. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Deed to Secure Debt and by law, including attorney’s fees (notice of intent to collect attorney’s fees having been given).
To the best knowledge and belief of the undersigned, the party (or parties) in possession of the subject property known as 2315 Creek View Drive, Augusta, GA 30907 is: 4 T’s Investments, LLC and/or tenant or tenants.
Said property will be sold subject to (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), (b) any matters which might be disclosed by an accurate survey and inspection of the property, and (c) all matters of record superior to the Deed to Secure Debt first set out above, including, but not limited to, assessments, liens, encumbrances, zoning ordinances, easements, restrictions, covenants, etc.
The following information is being provided in accordance with O.C.G.A. § 44-14-162.2. Irene Marie Ortega is the secured creditor under the above-referenced Deed To Secure Debt and Promissory Note being foreclosed. The following entity shall have full authority to negotiate, amend, and modify all terms of the above-described Deed To Secure Debt and associated Note on behalf of the secured creditor: Irene Marie Ortega, 635 Claredon Court, Lawrenceville, Georgia 30043 (773) 383-7845. O.C.G.A. § 44-14-162.2 states in pertinent part that, “nothing in this subsection shall be construed to require a secured creditor to negotiate, amend, or modify the terms of a mortgage instrument.”
The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code, and (2) final confirmation and audit of the status of the loan with the holder of the security deed.
