NOTICE OF PUBLIC HEARING

ZONING BOARD OF ADJUSTMENT
PLEASE TAKE NOTICE that on Thursday, July 9, 2026 at 7:30 P.M., in the City of Elizabeth City Council Chambers, third floor of City Hall, 50 Winfield Scott Plaza, Elizabeth, New Jersey, the Zoning Board of Adjustment ("Zoning Board") will hold a public hearing on the application of 315 Madison, LLC (the "Applicant"), seeking D6 Height Variance, and preliminary and final site plan with bulk ("C") variance approvals in connection with the property located at 305-319 Madison Avenue and identified as Block 281, Lots 1, 2, & 3 on the Tax Maps of the City of Elizabeth (the "Property").
The Applicant proposes to demolish the existing structures and replace them with a five-story mixed-use building. The mixed use is a permitted use in the C-2 Zone. Applicant proposes building 64 residential units (40 one-bedroom apartments, and 24 two-bedroom apartments) with a small commercial space on the first floor. Applicant is additionally proposing to consolidate lots 1, 2, and 3. The proposed building is 69 ft and five stories whereas the permitted height is 38 ft and three stories. As a result, the Applicant is seeking a d6 height variance.
The applicant is also seeking approval for the following bulk (c) variances:
Lot Depth: Required, 100 ft; Proposed, 82 ft
Front Yard Setback: Required, 35 ft; Proposed, 5 ft
Side Yard Setback: Required, 22 ft; Proposed, 3 ft (left side) and 5 ft (right side)
Rear Yard Setback: Required, 56.5 ft; Proposed, 5 ft
Maximum Impervious Coverage: Allowed, 60%; Existing, 100%; Proposed, 90.8%
Minimum Parking Spaces: Required, 108 spaces; Proposed, 93 spaces
Applicant further seeks any additional deviations, variances, waivers, exceptions, interpretations, de minimis exceptions to RSIS, modifications of conditions of prior approvals, continuation of any preexisting nonconforming conditions and other approvals reflected on the filed plans (as same may be further amended or revised from time to time without further notice) and/or relief that may be determined to be necessary during the review and processing of the application and/or based upon an analysis of the plans and testimony at the PUBLIC HEARING on the Application. The Applicant reserves the right to supplement its submission either prior to or at the PUBLIC HEARING on this matter.
All documents relating to this Application may be inspected by the public in the Office of the Bureau of Construction and Zoning, Division of Zoning and Land Use, 50 Winfield Scott Plaza, Elizabeth, New Jersey, during that Office's normal business hours, beginning ten (10) days prior to the public hearing, by contacting Zoning Board Secretary, Phyllis Reich via telephone at (908) 820-4037, during regular business hours, or via electronic mail at preich@elizabethnj.org or Pablo Garcia by calling 908-820-4036 or by email to pablo.garcia@elizabethnj.org. The public hearing may be continued without further notice on such additional or other dates as the Board may determine. When the case is called you may appear either in person or by agent or attorney and present objections which you may have to the granting of this Application. The PUBLIC HEARING may be continued without further notice on such additional or other dates as the Board may determine.
