ZONING BOARD OF ADJUSTMENT OF THE TOWNSHIP OF MAPLE SHADE
NOTICE OF HEARING
PLEASE TAKE NOTICE:
That Deerfield Associates, LP (the "Applicant") has filed an application for development with the Zoning Board of Adjustment of the Township of Maple Shade (the "Board") for Variance and Minor Site Plan Approvals for the Fox Meadow Apartments, located on Route 73, known as Block 172, Lots 1, 1.01, 1.02, and 1.04, in the Planned Development Zoning District of the Township (the "Property").
The Applicant is proposing to replace the existing solid waste and recycling containers at the Fox Meadow Apartment Complex with eighteen (18) Solid Waste and Recyclable Enclosures housing 3, 4 or 5 separate containers. Apartments are not identified as a permitted use in the Planned Development Zoning District, and the existing Fox Meadow apartment use is a non-conforming use. The proposed improvements are accessory to the principal apartment use on the Property.
The Applicant is requesting a variance from Section 205-67 of the Maple Shade Zoning Ordinance to expand a non-conforming parking space condition. The Applicant is proposing 2,346 parking spaces for the apartment complex, a reduction of 37 spaces from the 2,383 existing parking spaces. The number of existing parking spaces is a non-conforming condition as 2,984 parking spaces are required for the 1,492 apartment units. The variance is being requested by the Applicant pursuant to (i) N.J.S.A. 40:55D-70(d)(1) if the Board determines that construction of the proposed improvements is for an existing non-conforming apartment use; (ii) N.J.S.A. 40:55D-70(d)(2) if the Board finds that the proposed improvements represent an expansion of the non-conforming apartment use; or (iii) N.J.S.A. 40:55D-70(c) if the Board determines that a bulk variance and not a use variance is required.
The Applicant is also requesting a waiver from Section 178-22.1(B)(6) requiring the submission of Environmental Impact Data. No other relief is known to be required. However, the Applicant is seeking approval of the plans that are on file with the Board Secretary. To the extent that additional approvals, variances, waivers and exceptions are needed to implement these plans, those approvals, variances, waivers and exceptions are being sought.
A public hearing has been scheduled by the Board for Wednesday, February 18, 2026 at 6:30 p.m., prevailing time, at the Maple Shade Municipal Complex, 200 Stiles Avenue, Maple Shade, New Jersey. During the Public Hearing, any interested party will have an opportunity to view the hearing in its entirety, be heard, ask questions, provide comments, or offer evidence, in accordance with the rules of the Board. During the proceeding, the Board may be asked to render interpretations of the Ordinances of the Township of Maple Shade as they apply to the application. Other waivers from a strict application of other ordinance standards may be sought. No other relief is known to be required. However, the Applicant is seeking approval of the plans that are on file with the Director of Community Development.
The Applicant's application and plans are on file with the Maple Shade Director of Community Development at the official's office maintained at the Municipal Complex. They are available for public inspection between the hours of 7:30 a.m. and 3:30 p.m. Monday through Friday. The Applicant reserves the right to supplement its submission either prior to or at the public hearing scheduled in this matter. At the hearing, or at any adjourned hearing date or location, all interested in the application will be accorded a right to speak or otherwise to exercise the right granted to them under the Municipal Land Use Law of the State of New Jersey, N.J.S.A. 40:55D-1, et seq.
