In accordance with the Corrected Judgment and Decree of Foreclosure by Judicial Sale entered on September 26, 2025, in the above captioned action brought to foreclose that certain mortgage given by Charles P. Higgs to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for IndyMac Bank, F.S.B., dated March 20, 2008, and recorded in Book 810, at Page 477, of the City of South Burlington Land Records, of which mortgage the undersigned is the present holder by virtue of the following Assignments of Mortgage: (1) Assignment of Mortgage from Mortgage Electronic Registration Systems, Inc. (MERS) solely as nominee for IndyMac Bank, F.S.B. to OneWest Bank, FSB recorded in Book 1141, at Page 270 (2) Constructive Assignment of Mortgage from OneWest Bank, FSB to Nationstar Mortgage, LLC pursuant to Paragraph 4 of the Corrected Judgment and Decree of Foreclosure by Judicial Sale entered on September 26, 2025 and recorded in Book 1810, at Page 189 (3) Assignment of Mortgage from Nationstar Mortgage LLC to Wilmington Savings Fund Society, FSB not in its individual capacity, but solely as Owner Trustee of CSMC 2021-PRL11 Trust recorded in Book 1649, at Page 163, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on June 17, 2026 at 12:00 PM at 52 Stone House Commons a/k/a 52 Stonehouse Commons, South Burlington, VT 05403 all and singular the premises described in said mortgage,
To Wit:
Being all and the same land and premises conveyed to Brenda C. Wilson by Warranty Deed of Stonehouse Commons, LLC dated October 28, 2002 and recorded in Volume 576, at Pages 418-420 of the City of South Burlington Land Records being more particularly described as follows:
Being condominium unit No. 3 of the Stonehouse Condominiums (hereinafter “the Unit”), being also referred to in the Floor Plans referenced below as Unit 52, as described and depicted in the Declaration of Condominium of Stonehouse Condominiums and the exhibits incorporated therein including Floor Plans and the Site Plan referenced below, together with an undivided interest in the Common Areas and Facilities, all as set forth in the said Declaration. Said Declaration is dated April 9, 2002 and is recorded in Book 549, at Page 169 of the Land Records of the City of South Burlington. The post office address of the Unit is 52 Stonehouse Common, South Burlington, Vermont.
The location of the Unit and the land comprising the common elements of the said condominium are depicted on a site plan entitled “Stone House Common, South Burlington, Vermont, Site Plan,” prepared by Llewellyn-Howley, Incorporated, dated January 4, 2001 and recorded in Book 495, at Page 98 of the Land Records of the City of South Burlington. Said property is comprised of the following two parcels of land:
Parcel 1:
Being all and the same land and premises conveyed to Stonehouse Commons, LLC, by Warranty Deed of Lawrence L. Caron and Cynthia O. Caron dated June 28, 2001 and recorded in Book 510 at Page 134 of the Land Records of the City of South Burlington.
Parcel 2:
Being all and the same land and premises conveyed to Stonehouse Commons, LLC by Warranty Deed of Lawrence F. Shepard and Sandra L. Shepard dated June 28, 2001 and recorded in Book 510 at Page 136 of the Land Records of the City of South Burlington.
The specific location of the Unit, its boundaries, and the floor plans of the Unit are described and depicted as Unit 52 on floor plans entitled “Stone House Common, Stone House, South Burlington, Vermont” prepared by Michael Dugan and dated April 23, 2002 and recorded in Book 495 at Page 134 of the said South Burlington Land Records.
The property is subject to the terms and conditions of State of Vermont Subdivision Permit No. EC-4-2387, dated June 18, 2001 and recorded in Book 549, at Page 122 of the South Burlington Land Records, and State of Vermont Water Supply and Wastewater Disposal Permit No. WW-4-1522 dated June 18, 2001 and recorded in Book 549 at Page 124 of the South Burlington Land Records.
The property is further subject to the following easements and rights of way:
a. Easement Deed for pipelines to Vermont Gas Systems dated August 10, 2001 and recorded in Book 517 at Page 461 of the City of South Burlington Land Records.
b. Sewer easement to Town of South Burlington dated June 1, 1966 and recorded in Book 78 at Page 368 of the South Burlington Land Records.
c. 20 foot wide easement and right of way reserved by Lawrence L. and Cynthia O. Caron in their Warranty Deed to Stonehouse Commons, LLC dated June 28, 2001 and recorded in Book 510 at Page 134 of the South Burlington Land Records.
d. Easement to Green Mountain Power Corporation dated October 4, 2001 and recorded in Book 534 at Page 543 of the South Burlington Land Records.
For as long as the Grantor owns any interest in the Property, the Grantor hereby reserves for itself and its successors and assigns, easements, rights of way, and licenses, and the right to grant easements, rights of way, and licenses to others over, under, across and through all of the Property for the purpose of: (i) completing the improvements to the Property described in this Declaration, including buildings, driveways, sewer lines, water lines, storm water drainage systems, parking areas, sidewalks, fences, trees, shrubs, landscaping, utility lines, equipment and improvements, and for the purpose of sales activities, such as erecting signs advertising the Condominium; (ii) providing utility service to the Property; and (iii) compliance with permits, laws, rules, regulations, ordinances and other governmental requirements.
The conveyance is made subject to the provisions of the Vermont Common Interest Ownership Act, Title 27A, Vermont Statutes Annotated, Chapter 17.
The percentage of undivided interest in the Common Areas and Facilities and in the Limited Common Areas and Facilities of Stonehouse Commons hereby conveyed which shall be appurtenant to the Unit for all purposes is 15.429%. The Unit shall be used for residential purposes only. The Unit is subject to further use restrictions as set forth in the aforementioned Declaration and By Laws.
Reference is hereby made to a Deed from Christine Leonard, Executrix of the Estate of Brenda C. Wilson dated May 1, 2006 and recorded in the Land Records of the City of South Burlington at Book 748, Page 415.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
The public sale may be adjourned one or more times for a total time not exceeding 30 days, without further court order, and without publication or service of a new notice of sale, by announcement of the new sale date to those present at each adjournment or by posting notice of the adjournment in a conspicuous place at the location of the sale.
Terms of Sale: $10,000.00 to be paid in cash or by certified check by the purchaser at the time of sale, with the balance due at closing. The sale is subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens, if any, which take precedence over the said mortgage above described.
The Mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
