ZONING BOARD OF ADJUSTMENT
NOTICE OF PUBLIC HEARING
PLEASE TAKE NOTICE that La Cocina Latin Cuisine, LLC (the "Applicant") submitted an application (the "Application") to the Township of Pennsauken Zoning Board of Adjustment (the "Zoning Board") for minor site plan, use variance and bulk variance approval for the property identified on the Tax Map of the Township of Pennsauken as Block 4706, Lot 3 and commonly known as 5010 Westfield Avenue, Pennsauken, New Jersey 08110 (the "Property" or "Subject Property"). The Property is presently located in the Professional Office District ("P-1 Zone") within the Township of Pennsauken (the "Township").
The Applicant is seeking D-1 use variance relief from Section 141-85(A) to construct a thirteen (13) space parking lot on the presently vacant 7,500 square foot Property for the adjacent La Cocina Latin Cuisine restaurant. A commercial parking lot is not a permitted principal use in the P-1 Zone. The Applicant is requesting preliminary and final minor site plan approval in conjunction with the use variance for the proposed improvements to the Property. The following bulk variances are being requested from the following sections:
- Section 141-81(C)(2)(a) - The minimum required front yard setback is 10 FT, whereas 7.5 FT is proposed.
- Section 141-81(C)(2)(b) - The minimum required side yard setback is 10 FT, whereas 5 FT and 2 FT is proposed.
- Section 141-81(C)(2)(c) - The minimum required rear yard setback is 35 ft, whereas 2.10 ft is proposed.
- Section 141-81(C)(3)(b) - The maximum permitted impervious lot coverage is 85%, whereas 86.45% isproposed.
- Section 141-81(D) - A masonry wall or opaque fence with a minimum height of six feet is required along any rear or side lot line that abuts a residential use or zoning district, whereas a four-foot-high chain link fence is proposed along the rear lot line abutting the R-3 Zone.
- Section 141-87 - A loading space is required, whereas there are no dedicated loading spaces provided.
- Section 141-73 - Parking spaces are required to be paved with asphalt or concrete, whereas the parking area and spaces are proposed to be paved with crushed stone materials.
- Section 141-73 - Parking spaces are required to measure a minimum of 10 feet in width and 20 feet in depth, whereas the parking spaces measure 9 feet in width and 18 feet in depth.
- Section 141-81(H)(4) - Buffer strips are required to measure at least six (6) feet in width, whereas there is no buffer strip provided.
- Section 141-81(H)(4) - Buffer strips are required to be graded and planted with grass seed or sod, shrubs, or trees, whereas no buffer strip is provided.
- Any and all other variances as may be required by the Township of Pennsauken Zoning Board and/or its professional consultants for any other existing site conditions.
The Applicant proposes the requested relief will enable the Property to be put to productive use and to be improved and utilized in a manner compatible with and complementary to the surrounding area. Additional testimony in support of the requested relief will be provided at the hearing.
The Applicant reserves the right to request any and all variances, waivers, and/or other relief that may be required after review of the Application by the Zoning Board and its professional staff, or that otherwise may be necessary. This is a continuing Notice and the Application may be postponed or adjourned to another meeting of said Zoning Board without any further notice being required.
A public hearing of this Application (the "Public Hearing" or "Hearing") will be held before the Township of Pennsauken Zoning Board of Adjustment on July 22, 2026 at 6:30 P.M. The Zoning Board's public meetings will be held in the 2nd Floor Committee Meeting Room of the Municipal Building located at 2400 Merchantville Avenue, Pennsauken, New Jersey 08110.
At the time of the Public Hearing, anyone may appear individually or by attorney, and present any objection which they may have to granting this Application. The Application, any maps, and/or documents for which approval is sought are available for examination in the Township's Zoning Office during normal business hours.
