Tanglewood Nature Center Canopy Walkway Project Bid
Sealed Bids for the construction of the Project will be received at the Tanglewood Nature Center Museum Offices located at 443 Coleman Avenue, NY 14903, until Thursday, October 16, 2025, at 2:00 PM. At that time, the Bids will be publicly opened and read. BIDS SHALL BE SUBMITTED IN A SEALED ENVELOPE ENTITLED:
Tanglewood Nature Center Canopy Walkway Project Bid
The Canopy Walkway Project includes, but not limited to, the following Work:
Canopy Walkway (Phoenix Experiential Designs)
• Selective Tree/Brush Clearing
• Entrance, Emergent Tower and Pond View Platforms
• 685 LF of Fixed Bridge w/ Railings
• 100 LF of Suspension Bridge w/ Railings
• Nine (9) - Two Column Supports
• Six (6) - Three Column Supports
Site Plan Elements (LaBella Associates)
• Driveway and Parking Improvements
• 8' Wide Trail from Parking to Canopy (Portion is Elevated Boardwalk)
• Electric Service to Canopy from Museum
• Stormwater Management
• Lighting and Landscaping
EACH BID SHALL BE ACCOMPANIED BY A DEPOSIT IN THE AMOUNT OF: Five Percent (5%) of the Total Gross Sum Bid in the form of a Bid Bond. Cash will not be accepted as a deposit. Bid deposits of all unsuccessful bidders shall be returned promptly upon execution of the contract with the successful bidder.
Obtaining the Bidding Documents
The Issuing Office for the Bidding Documents is Fagan Engineers & Land Surveyors, PC, 113 East Chemung Place, Elmira, NY 14904. Bidding Documents may be obtained on or after September 17, 2025, by one of the following methods:
• Bidding Documents may be viewed online by registering (provide a contact name and e-mail) with the Issuing Office at Bidding@FaganEngineers.com. Following registration, a link will be sent to download complete sets of Bidding Documents the Issuing Office's website as "zipped" portable document format (PDF) files. There are no fees or charges associated with downloading the Bidding Documents. Note: registering with the Issuing Office is mandatory to assure notice of any addendums.
Printed Bidding Documents may be picked up from the Issuing Office by the prospective Bidder by appointment. A payment of $100.00, in the form of a check or money order made payable to Fagan Engineers & Land Surveyors, PC, is required for each set of documents. Cash is not accepted.
• Printed Bidding Documents may be shipped by the Issuing Office for a separate non-refundable payment of $50.00. Upon Issuing Office's receipt of two separate payments ($50.00 document refundable fee and $50 non-refundable shipping fee), printed Bidding Documents will be sent via next day delivery service through the U.S. Postal Service.
• If the prospective Bidder provides a customer number for a specified delivery company (such as Fed Ex, or UPS), then upon receipt of the $100.00 document fee the Issuing Office will deliver the printed Bidding Documents via the shipping method selected by the prospective Bidder (shipping charges billed to the prospective Bidder's account). Bidding Documents may be purchased from the Issuing Office during the office hours by appointment only. Cost does not include shipping charges. Upon Issuing Office's receipt of payment, printed Bidding Documents or electronic documents on compact disc will be sent via the prospective Bidder's delivery service. The charge amount will depend on the shipping method chosen.

Funding
This contract is funded in part with Local, New York State and Federal funds including Chemung County American Rescue Plan Act (ARPA), New York State Empire State Development (ESD) Market NY and Federal Appalachian Regional Commission (ARC). The Contractor must comply with: Davis Bacon Act and Related Acts; The Copeland "Anti-Kickback" Act; The Contract Work Hours and Safety Standards Act and Wage Rate Determination.
American Iron and Steel
Section 746 of Title VII of the Consolidated Appropriations Act of 2017 (Division A - Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2017) and subsequent statutes mandating domestic preference applies an American Iron and Steel requirement to this project. All iron and steel products used in this project must be produced in the United States. The term "iron and steel products" means the following products made primarily of iron or steel: lined or unlined pipes and fittings, manhole covers and other municipal castings, hydrants, tanks, flanges, pipe clamps and restraints, valves, structural steel, reinforced precast concrete, and Construction Materials.
Build America, Buy America Act
This agreement is for services related to a project that is subject to the Build America, Buy America Act (BABAA) requirements under Title IX of the Infrastructure Investment and Jobs Act ("IIJA"), Pub. L. 177-58. Absent an approved waiver, all iron, steel, manufactured products, and construction materials used in this project must be produced in the United States, as further outlined by the Office of Management and Budget's Memorandum M-22-11, Initial Implementation Guidance on Application of Buy America Preference in Federal Financial Assistance Programs for Infrastructure, April 18,2022.
Please take notice:
• Bids received via facsimile or electronically will not be considered.
• Bids must be made upon and in accordance with the Bid Documents including bid form supplements.
• Bids must be submitted in duplicate (one original and one exact copy).
• Bidders shall submit proof of qualifications to perform the Work, refer to the bid form supplements.
• Tanglewood Nature Center reserves the right to accept or reject any and all bids submitted and to waive any informality.

• Engineer will transmit to all prospective and registered Bidders of record such addenda as Engineer considers necessary in response to questions arising during the pre-bid period. Oral statements may not be relied upon and will not be binding or legally effective.
