Apart from the proceeding that resulted in the issuance of the order sought to be modified herein, Petitioner has not participated in other litigation concerning the custody of the same children. 9. I know of no person(s) not a party to the proceedings who claim(s) to have custody or visitation rights with respect to the child(ren) affected by this proceeding. 10. It is in the best interests of the children that this order be modified as follows for the following reasons: Award- ing sole legal and physical custody of both children to the Petitioner Father and terminating the Respondent Mother's right to child support due to her abandonment of the chil- dren in or about April 2021. 11. The following circumstances affecting the children have changed since the order was originally issued: The Respon- dent Mother, a drug addict and alcohol abuser, abandoned the children in or about April 2021. For a period of time, the children were then living with Petitioner and the Respon- dent's mother. In or about May 15, 2024, Petitioner relo- cated to New York with the children and enrolled them in school in New York for the 2024/2025 school year. Petitioner cares for the children exclusively – physically, financially, and emotionally – and has had no contact with the Respon- dent Mother. 12. No proceeding has been commenced that could affect this action. 13. The court that issued the order sought to be modified identified the following jurisdictional basis or bases for its issuance: The child lived in that state or jurisdiction with a parent or person acting as a parent for at least six consecu- tive months before the proceeding was commenced. 14. This Court has jurisdiction to modify the order on the following ground(s): This Court should determine that the other state no longer has exclusive continuing jurisdiction, because neither the child, the child's parents nor any other person acting as a parent presently reside in the other state; 15. No previous application has been made to any court or judge for the relief herein. WHEREFORE, Petitioner requests that this Court issue: an order modifying the order of custody or visitation as follows: Awarding sole legal and physical custody of both children to the Petitioner Father and terminating Respondent Mother's right to child support; and an order providing such other and further relief as this Court may deem just and proper.
