By virtue and in execution of the Power of Sale contained in a certain mortgage given by Niall Hopkins and Louis F Hopkins a/k/a Louise F. Hopkins to Option One Mortgage Corporation, and now held by Wells Fargo Bank, National Association as Trustee for Option One Mortgage Loan Trust 2007-5, Asset-Backed Certificates, Series 2007-5, said mortgage dated February 9, 2007 and recorded in the Barnstable County Registry of Deeds in Book 21780, Page 51 as affected by a Confirmatory Mortgage recorded or filed at Barnstable County Registry in Book 36427 Page 89, said mortgage was assigned from American Home Mortgage Servicing, Inc. as successor-in-interest to Option One Mortgage Corporation to Wells Fargo Bank, N.A. as trustee for Option One Mortgage Loan Trust 2007-5 Asset-Backed Certificates Series 2007-5 by assignment dated November 21, 2008 and recorded with said Registry of Deeds in Book 23296, Page 30; for breach of the conditions in said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on March 5, 2026 at 11:00 AM Local Time upon the premises, all and singular the premises described in said mortgage, to wit:
The land in Yarmouth (South), together with the buildings thereon, bounded and described as follows:
LOT 36 on a plan of land entitled: "Hazelmoor, Section 2, Plan of Subdivision of Land of Eldredge F. and Elva Shaw in Yarmouth (South), Scale 1" = 80' August 20, 1954, Newell B. Snow, Engineer Buzzards Bay, Mass ., " which said plan is duly filed in the Barnstable County Registry of Deeds in Plan Book 117, Page 17. Said Lot contains 12,346 square feet of land more or less.
There is granted as appurtenant to the above described lot, a right of way over the streets and way, as shown on said plan in common with all others lawfully entitled thereto.
The above described lot is conveyed and subject to all rights, rights of way, reservations, restrictions and easements of record as the same are in force and applicable.
For title see deed recorded in Book 19030 Page 253.
The description of the property contained in the mortgage shall control in the event of a typographical error in this publication.
For Mortgagor’s Title see deed dated September 10, 2024 and recorded in the Barnstable County Registry of Deeds in Book 19030, Page 253.
TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer's or cashier's check within thirty (30) days after the date of sale.
