A petition has been presented to said Court by Simon Kendrick and Brigette Carty of Harwich, MA, representing that they hold as tenants in common undivided part or share of certain land lying in Yarmouth (South) in said County, and briefly described as follows:
The land in Yarmouth (South), Barnstable County, Massachusetts bounded and described as follows:
NORTHEASTERLY by Lot 47, as shown on hereinafter mentioned plan, two hundred seventy-one and 84/100 (271.84) feet;
SOUTHEASTERLY by Cranberry Lane, as shown on said plan, one hundred nine and 00/100 (109.00) feet;
SOUTHWESTERLY by Lot 49, as shown on said plan, two hundred seventy-three and 43/100 (273.43) feet; and
NORTHWESTERLY by land now or formerly of Lavaughney G. Nickerson et als, one hundred nine and 01/00 (109.01) feet, as shown on said plan.
Being LOT 48 containing 29,710 square feet, as shown on said plan of land entitled, "Section B, Driftwood on Bass River, Yarmouth, Mass. As surveyed for Herbert J. Keiser, Scale 1 inch = 80 feet, May 1954, Whitney & Bassett – Architects and Engineers, Hyannis, Mass", said plan is duly recorded in Plan Book 120, Page 119.
Together with a right of way in common with others entitled thereto over the streets and ways shown on said plan. Subject to taking for Cranberry Lane recorded Book 1196.
The common title to said land is derived under the Quitclaim Deed dated March 11, 2024, from Susan J. Higgins to Susan J. Higgins, Simon Kendrick and Brigette Carty, recorded with the Barnstable Registry of Deeds on March 21, 2024, at Book 36273, Page 40.
setting forth that they desire that all of said land may be sold at private sale for not less than Seven Hundred Thousand Dollars ($700,000.00) and to that end that a commissioner be appointed to make such partition and be ordered to make sale and conveyance of all, or any part of said land which the Court finds cannot be advantageously divided.
If you desire to object thereto you or your attorney should file a written appearance in said Court in Barnstable before ten o'clock in the forenoon on May 19, 2026, the return day of this citation.
