NOTICE TO TAXPAYERS OF THE PARK AND RECREATION DISTRICT OF THE TOWN OF SPEEDWAY, INDIANA OF PUBLIC HEARING ON PROPOSED PROJECT AND ADDITIONAL APPROPRIATION OF BOND PROCEEDS AND PRELIMINARY DETERMINATION TO ISSUE BONDS
Public Hearing on Proposed Project - Taxpayers of the Park and Recreation District (the "Park District") of the Town of Speedway, Indiana (the "Town") and all other persons affected hereby are notified that the Park and Recreation Board (the "Board") of the Park District (the "District"), at a meeting held on September 17, 2025, adopted a Declaratory Resolution (the "Declaratory Resolution") preliminarily finding that it will benefit the health and welfare and be of public utility and benefit to undertake the acquisition, construction and installation of certain additions and improvements to park facilities including any or all of the following, together with other related and necessary improvements in connection therewith: improvements to Leonard Park and Meadowood Park through the redesign and construction of the existing playgrounds of each park including the inspection, removal, disposal and/or rehabilitation of existing playground equipment, playground surfaces and related infrastructure including design, engineering, installation and inspection of replacement playground equipment, playground surfaces and related infrastructure and also including improvements to additional portions of the Speedway Parks System identified by the District as needing repair or upgrade (collectively, the "Project"). Notice is further given that general plans, specifications and estimated costs have been prepared and, along with the Declaratory Resolution, are on file and may be inspected at the office of the Clerk-Treasurer of the Town at 5300 Crawfordsville Rd., Speedway, IN 46224 during normal business hours. The estimated costs of the Project and the issuance and sale of special taxing district bonds in connection therewith, is in an amount not to exceed $2,500,000.
Further, notice is hereby given that the Board, on October 15, 2025, at 6:00 p.m. local time, at the Fisher Conference Room No. 1 located at the Speedway Government Complex, 5300 Crawfordsville Rd., Speedway, IN 46224, will hold a public hearing and receive and hear remonstrances from persons interested in or affected by such proceedings and will determine the benefit to the public health and welfare and determine the public utility and benefit of the Project. At the time fixed for the hearing or at any time prior thereto any person owning real or personal property located within the Park District or any owner of land to be injuriously affected under the Declaratory Resolution may file a written remonstrance with the Board. At such hearing, which may be adjourned from time to time, the Board will hear all persons interested in the proceedings and all remonstrances that have been filed. After considering this evidence, the Board will take final action determining the public utility and benefit of the proposed Project by either confirming, modifying, or rescinding the Declaratory Resolution.
Bond Hearing - Notice is hereby given to taxpayers of the Park District and other interested parties that the Board, immediately following the above hearing, will conduct a public hearing on the proposed issuance of special taxing district bonds of the Park District in the aggregate principal amount not to exceed $2,500,000 (the "Bonds") for the purpose of (i) financing the costs of the Project, (ii) paying capitalized interest, if necessary, and (iii) paying costs of issuance of the Bonds, if required. At the public hearing, all persons shall have the right to appear and be heard on the proposed issuance of the Bonds.
Appropriation Hearing - Notice is hereby given to taxpayers of the Park District that the Board, immediately following the above hearings, will conduct a public hearing and consider the appropriation of the funds of the Park District in an amount not to exceed $2,500,000 to be applied to the costs of the Project, capitalized interest on the Bonds, if necessary, and the cost of issuance of the Bonds, if required. The funds to meet this appropriation are to be provided by the issuance and sale of the Bonds. The foregoing appropriation is in addition to all appropriations provided for in the existing budgets and levies. Taxpayers of the Park District appearing at the hearing shall have the right to be heard in respect to this additional appropriation.
Determination to Issue Bonds - Taxpayers of the Park District are further notified that at its September 17 meeting, the Park Board preliminarily determined to issue the Bonds as special taxing district bonds, in one or more series, in accordance with Ind. Code 36-10-3, as amended, in an aggregate principal amount not to exceed $2,500,000 for the purpose of financing (i) the costs of the Project, (ii) capitalized interest, if necessary, and (iii) costs of issuing the Bonds. This notice of determination is provided by the Park District in accordance with Ind. Code §6-1.1-20-5. The issuance of the Bonds will be conditioned upon completion of the public hearing on the matters as herein provided and all other conditions of Indiana law necessary to be completed prior to the issuance of the Bonds.
