TOWN OF SPEEDWAY, INDIANA
NOTICE OF THE ADOPTION AND THE PURPORT OF AN ORDINANCE AUTHORIZING THE CONSTRUCTION OF CERTAIN IMPROVEMENTS AND EXTENSIONS TO THE TOWN'S SEWAGE WORKS SYSTEM AND THE ISSUANCE OF BONDS THEREFORE
Users of the sewage works system (the "System") of the Town of Speedway, Indiana (the "Town"), owners of properties served or to be served by the System and other interested persons are hereby notified that on April 13, 2026 the Town Council of the Town adopted Ordinance No. 1424 (the "Ordinance") authorizing the acquisition, construction and improvement of certain additions and repairs to the System as set forth in the Ordinance (collectively the "Projects") all as described or specified in the plans and specifications for the Projects prepared by DCCM Infrastructure, Inc. and referenced in the Ordinance. The total cost of the Projects and the financing thereof is estimated to not exceed $20,400,000.
The Ordinance further directs that a portion of the cost of the Projects be financed by the issuance of the Town's Sewage Works Revenue Bonds in one or more series and in one or more aggregate principal amounts not to exceed a total of $18,700,000, for the purpose of paying a portion of the costs of the Projects and related issuance and financing costs (the "Bonds") which Bonds will be payable from the net revenues of the System. The remaining costs of the Project and the financing thereof is to be paid by funds currently available to the Town for that purpose. It is anticipated that the Bonds will be sold at public or private sale in accordance with applicable law but the Town reserves the right to sell the Bonds to the Indiana Finance Authority through the State's Wastewater Revolving Loan Fund. The Bonds shall be payable annually on September 1 of each year, and shall bear interest paid semi-annually at a rate or rates not exceeding seven percent (7%) per annum if issued on a taxable basis and six percent (6%) per annum if issued on a tax-exempt basis and shall be payable over a period ending no later than twenty-two (22) years after the date of issuance. The Bonds will be issued in parity with the Town's Sewage Works Refunding Revenue Bonds, Series 2020A currently outstanding in the amount of $8,730,000 as defined and described in the Ordinance.
A description of the Projects, along with copies of specifications and costs and the Ordinance are available for examination and copying at the Office of the Speedway Clerk-Treasurer located at 5300 Crawfordsville Road, Speedway, IN 46224 during normal business hours. Objections to the Projects and the Bonds may be filed within the time and in the manner provided in Ind. Code 36-9-23, as amended.
