NOTICE OF SUBSTITUTED TRUSTEE’S SALE
WHEREAS, on May 8, 2023, Vintage Apartments Holdings, LLC, a Delaware limited liability company, executed a Deed of Trust, Assignment of Rents, Security Agreement and Fixture Filing (“Deed of Trust”) in favor of Jenelle Hellekson, Esq., of McEwen Gisvold LLP, an individual, as trustee for the benefit of Standard Insurance Company, an Oregon corporation (“Beneficiary”), which Deed of Trust was filed in the office of the Chancery Clerk of the First Judicial District, Hinds County, Mississippi on June 6, 2023 and recorded in Book 7295 at Page 7764; and
WHEREAS, the Deed of Trust provides for substitution of the Trustee by Beneficiary; and
WHEREAS, Beneficiary, by instrument dated May 18, 2026 and recorded in the office of the Chancery Clerk of the First Judicial District, Hinds County, Mississippi in Book 7333 at Page 4002, substituted as Trustee in the Deed of Trust, Jason E. Fortenberry, in the place and stead of Jenelle Hellekson, Esq., of McEwen Gisvold LLP, an individual; and
WHEREAS, default having been made in the terms and conditions of the Deed of Trust and the indebtedness secured thereby, and the entire indebtedness secured thereby having been declared to be due and payable in accordance with the terms and provisions of the Deed of Trust and the indebtedness secured thereby, and the owner of the indebtedness secured by the Deed of Trust, Standard Insurance Company having requested the undersigned to advertise and sell the property therein conveyed for the purpose of raising the funds due thereunder together with any attorneys’ fees, trustee fees and sale expenses; and
NOW THEREFORE, I, the undersigned Jason E. Fortenberry, Substituted Trustee, will by virtue of the power and authority vested in me as Substituted Trustee, on July, 15, 2026, between the legal hours of 11:00 a.m. and 4:00 p.m., at the Main North door of the Hinds County Courthouse, First Judicial District, 407 East Pascagoula Street, Jackson, Mississippi, offer for sale and sell at public outcry until sale is concluded, to the highest and best bidder, for cash the property located in the First Judicial District of Hinds County, Mississippi, together with all improvements and appurtenances, and more particularly described as follows (the “Real Property”):
All that certain lot, piece or parcel of land, with the buildings and improvements thereon erected, situated, lying and being in the City of Jackson, County of Hinds, State of Mississippi.
Parcel 1
A parcel of land situated in the NE ¼ of Section 6, and the NW ¼ of Section 5, Township 5 North, Range 1 East, being more particularly described as follows:
Beginning at a point on the Eastern right-of-way line of Ellis Avenue, said point being the true point of beginning; Thence, S 89° 23' 05? E for a distance of 331.52 feet to a point on the Western right-of-way line of Houston Avenue; Thence, along said right-of-way S 00°46'10? W for a distance of 620.43 feet to a point on the Northern right-of-way line of First Avenue; Thence, along said right-of-way N 88°25'35? W for a distance of 324.07 feet to a point on the Eastern right-of-way line of Ellis Avenue; Thence along right-of-way line N 00°04'21? E a distance of 615.04 feet to the point of beginning.
Parcel 2
A parcel of land situated in the NE ¼ of Section 6, and the NW ¼ of Section 5, Township 5 North, Range 1 East, being more particularly described as follows: Beginning at a point on the Western right-of-way line of Houston Avenue, said point being the true point of beginning; Thence, along said right-of-way line, S 00°08'34? W for a distance of 507.70 feet to a point; Thence, departing said right-of-way, N 89°23'05? W for a distance of 163.76 feet to a point; Thence N 00°08'34? E a distance of 506.35 feet to a point; Thence, S 89°51'26? E for a distance of 163.75 feet to a point on the point of beginning.

Vintage Apartments Holdings, LLC in the Deed of Trust also granted to the Beneficiary a security interest in certain personal property. Pursuant to Section 75-9-604(a) of the Mississippi Code, Beneficiary, at the same time and place and on the same terms as the sale of the above-described Real Property, will offer for sale and sell all of Vintage Apartments Holdings, LLC’s rights in and to the following described personal property:
(a) All rents, income, contract rights, issues and profits now due or which may become due under or by virtue of any lease, rental agreement or other contract, whether written or oral, for the use or occupancy of the Real Property or any part thereof, together with all tenant security deposits;
(b) All buildings and improvements now or hereafter thereon, and all appurtenances, easements, right in party walls, water and water rights, pumps and pumping plants and all shares of stock evidencing the same;
(c) All fixtures and property now or hereafter attached to or used in the operation of the Real Property, including but not limited to machinery, equipment, appliances, and fixtures for generating or distributing air, water, heat, electricity, light, fuel or refrigeration, or for ventilating or sanitary purposes, or for the exclusion of vermin or insects, or for the removal of dust, refuse or garbage, all wallbeds, wallsafes, built-in furniture and installations, shelving, lockers, partitions, door stops, vaults, elevators, dumbwaiters, awnings, window shades, venetian blinds, light fixtures, fire hoses and brackets and boxes for same, fire sprinklers, alarm systems, drapery rods and brackets, screens, linoleum, carpets, plumbing, laundry tubs and trays, ice boxes, refrigerators, heating units, stoves, water heaters, incinerators, communication systems and all installations for which any such building is specifically designed;
(d) All awards, compensation and settlements in lieu thereof made as a result of the taking by power of eminent domain of the whole or any part of the Real Property;
(e) All trade names by which all or any part of the Real Property is known, any books and records relating to the use and operation of all or any portion of the Real Property, all present and future plans and specifications and contracts relevant to the design, construction, management or inspection of any construction of any improvements on the Real Property and all present and future licenses, permits, approvals and agreements with or from any municipal corporation, county, state or other governmental or quasi-governmental entity relevant to the development, improvement or use of all or any portion of the Real Property;
(f) All rights of Vintage Apartments Holdings, LLC in and to any escrow or withhold agreements, surety bonds, warranties, management contracts, leasing or sales agreements with any real estate agents or brokers, and services contracts with any entity, which are in any way relevant to the development, improvement, leasing, sale or use of the Real Property or any personal property located thereon; and all of said items whether now or hereafter installed being hereby declared to be, for all purposes, a part of the realty; and all the estate, interest or other claim or demand, including insurance, in law as well as in equity, which Vintage Apartments Holdings, LLC now has or may hereafter acquire, in and to the aforesaid Real Property; the specific enumerations herein not excluding the general; and
(g) All additions, accessions, replacements, substitutions, proceeds and products of the collateral described herein.
The sale of the above-described personal property will be “as is”, “where is”, and without any warranties, either express or implied, of any kind or nature.
The sale of the Real Property shall be subject to any and all instruments of record, prior liens, encumbrances, deeds of trust, easements, restrictions, building lines, unpaid taxes, assessments, penalties and interest, if any. The title is believed to be good, but I will convey and sell only such title as is vested in me as Substituted Trustee. The right is reserved to adjourn the day of the sale to another day or time certain without further publication, upon announcement at the time for the above.
