NOTICE OF DEFAULT AND FORECLOSURE SALE
WHEREAS, on October 23, 2009, a certain Deed of Trust was executed by Susan B. Jefferson, as mortgagor or borrower, in favor of Wells Fargo Bank, N.A., as mortgagee or lender, and William H. Glover, Jr., as trustee, and was recorded in Book 7093 at Page 159 as corrected by Affidavit of Scrivener's Error recorded in Book 7126 at Page 4685 and as corrected and re-recorded in Book 7127 at Page 9640 and as corrected by Affidavit of Correction recorded in Book 7284 at Page 74 in the office of the Chancery Clerk of the First Judicial District of Hinds County, Mississippi; and
WHEREAS, the Deed of Trust was insured by the United States Secretary of Housing and Urban Development (the "Secretary"), pursuant to the National Housing Act for the purpose of providing single family housing; and
WHEREAS, the beneficial interest in the Deed of Trust is now owned by the Secretary, pursuant to an Assignment of Deed of Trust dated March 6, 2024, and recorded in Book 7305 at Page 6023 in the office of the aforesaid Chancery Clerk; and
WHEREAS, a payment default has been made in the covenants and conditions of the Deed of Trust, and no payment has been made sufficient to restore the loan to currency; and
WHEREAS, the entire amount delinquent as of January 29, 2026, is $85,099.88; and
WHEREAS, by virtue of this default, the Secretary has declared the entire amount of the indebtedness secured by the Deed of Trust to be immediately due and payable and instructed the undersigned Foreclosure Commissioner to foreclose on the collateral securing the indebtedness.
NOW, THEREFORE, pursuant to powers vested in Underwood Law Firm PLLC by the Single Family Mortgage Foreclosure Act of 1994, 12 U.S.C. 3751 et seq., by 24 CFR part 27, subpart B, and by the Secretary's designation of Underwood Law Firm PLLC as Foreclosure Commissioner by instrument recorded in Book 7318 at Page 8965, notice is hereby given that on March 10, 2026, between the hours of 11:00 a.m. and 4:00 p.m. prevailing Central Time all real and personal property at or used in connection with the following described premises (the "Property") will be sold at public auction to the highest bidder for cash at the North Front Door of the Hinds County Courthouse (1st Judicial District), 407 East Pascagoula Street, Jackson, MS 39201:
Lot 60, Bel Air Estate, Part 6, a Subdivision according to a map or plat thereof which is on file and of record in the Office of the Chancery Clerk of Hinds County at Jackson Mississippi in Plat Book 22 at Page 35, reference to which is hereby made in aid of and as a part of this description.
Commonly known as: 2002 Queensroad Ave., Jackson, MS 39213.
The Secretary presently intends to bid $85,099.88 and reserves the right to adjust its bid as necessary.
All funds must be submitted in the form of cash or a certificated check or cashier's check made payable to Underwood Law Firm PLLC. If the Secretary is the highest bidder, the Secretary need not pay the bid amount in cash. The successful bidder will pay any and all conveyance fees and other costs associated with the transfer of title as well was all real estate and other taxes that are due on the Property.
There is no right of redemption, or right of possession based upon a right of redemption, in the mortgagor or others subsequent to a foreclosure completed pursuant to the Act. Therefore, the Foreclosure Commissioner will issue a Deed to the purchaser(s) upon receipt of the entire purchase price in accordance with the terms of the sale as provided herein. HUD does not guarantee that the Property will be vacant.
The scheduled foreclosure sale shall be cancelled or adjourned if it is established that the default or defaults upon which the foreclosure is based did not exist at the time of service of this Notice of Default and Foreclosure Sale, or all amounts due under the mortgage agreement are tendered to the Foreclosure Commissioner, in the form of a certified or cashier's check payable to the Secretary of HUD, before public auction of the Property is completed.
