Substitute Trustee's Notice of Sale WHEREAS, on the 8th day of October, 2010, Patrick J. Gregory and Josephine Brown Gregory executed a Deed of Trust to Melanie Beth Thigpen, Trustee, for the benefit of Charles Rabinowitz, Michael Rabinowitz, and Jay Rabinowitz, which Deed of Trust is recorded in the office of the Chancery Clerk of the County of Hinds, Second District, State of Mississippi; and WHEREAS, Melanie Beth Thigpen has heretofore substituted Charles Rabinowitz as Trustee by instrument dated October 8, 2010, and filed for record October 27, 2010, Book 7110, Page 9605, in the office of the Chancery Clerk of Hinds County, Mississippi, Second District; and WHEREAS, default has been made in the payment of the indebtedness secured by said Deed of Trust, which default continues, and Charles Rabinowitz, as the legal holder of the Note secured by said Deed of Trust, has requested the undersigned to sell the property described hereinafter for the purpose of satisfying the indebtedness and costs of sale. The Substitute Trustee, the beneficiary, and/or the legal holder of the indebtedness expressly reserve the right to withhold acceptance of any bid, to decline to conclude the sale, and to withdraw the property from sale before completion of the sale. 2.- Right to Reject Bids. Any bid received at the sale, and any striking off or announcement of a high bid, shall be subject to final confirmation and approval by the Substitute Trustee, the beneficiary, and/or the legal holder of the indebtedness. No sale shall be final, binding, or complete unless and until such confirmation and approval are given. 5.- Minimum Bid / Upset Price. The Substitute Trustee, the beneficiary, and/or the legal holder of the indebtedness reserve the right to establish, announce, modify, or waive a minimum bid or upset price before or at the time of sale. No bid below any applicable minimum bid or upset price shall be required to be accepted. 6.- Postponement, Continuance, Adjournment, or Cancellation. The Substitute Trustee reserves the right to postpone, continue, adjourn, or cancel the sale, whether before or during the sale, and to re-notice or re-offer the property for sale as permitted by applicable law and the Deed of Trust. 7.- Cash Sale; Payment Terms. Any accepted bid shall be for cash. The successful bidder, if any, must tender payment in immediately available funds in accordance with the terms announced by the Substitute Trustee at or before the sale. Failure to timely tender payment may result in rejection of the bid and resale of the property. 8.- Title Conveyed. Title to the above-described property is believed to be good, but the Substitute Trustee will convey only such title as is vested in the Substitute Trustee under the Deed of Trust and applicable law. 9.- Additional Announced Terms. The Substitute Trustee may announce additional or supplemental terms and conditions at the sale.
