Substitute Trustee's Notice of Sale
WHEREAS, Ephant Group – Sparkle, LLC, executed, acknowledged and delivered to Brandon C. Hull, Trustee, a certain Deed of Trust dated the 2nd day of December, 2022, and of record at Instrument No. 202212020032656 in the Register's Office for Knox County, Tennessee, to secure a certain indebtedness owing to Greeneville Federal Bank, FSB, and more fully described therein;
WHEREAS, on the 17th day of March, 2026, the holder of the note securing the indebtedness executed an appointment of Substitute Trustee nominating and appointing KENNETH CLARK HOOD, Substitute Trustee, instead of the said Brandon C. Hull, Trustee, said Substitution of Trustee recorded at Instrument No. 202603200052297in the Register's Office for Knox County, Tennessee;
WHEREAS, default has been made in the payment of said indebtedness and the same has become due and payable and the owner and holder of said indebtedness has declared the entire balance owing thereon due and payable and has instructed the said Trustee to foreclose said Trust Deed and to advertise and sell the property therein and herein described, upon the terms and conditions set forth in said Trust Deed; and
NOW, THEREFORE, notice is hereby given that I will on the 27th day of April, 2026, at 1:30 P.M. prevailing standard time in Knox County, Tennessee, at the main entrance to the Knox County Courthouse in Knoxville, Tennessee, sell the following described real estate at public auction, for cash, to the highest bidder, and in bar of the equity of redemption, the statutory right of redemption, dower and homestead, but subject to all liens, encumbrances, easements, rights-of-way, set-back lines, restrictions, covenants, and unpaid taxes affecting the subject property having priority over the lien created by the subject deed of trust. The property to be sold is described as follows:
SITUATED in District Five (5) of Knox County, Tennessee, and within the 39th Ward of the City of Knoxville, 'Tennessee, and being a 1.3246 acre tract of land identified on the plat entitled "Revised Plat of Property of Robert Bean" of record in Cabinet P, Slide 134-A, in the Register's Office for Knox County, Tennessee, and being more particularly described as follows:
BEGINNING at an iron pin located in the northeastern right away of Central Avenue Pike, said iron pin being located 35 feet from the centerline of Central Avenue Pike and 150.60 feet in a southeasterly direction along the northeastern right of way of Central Avenue Pike from the point of intersection of Tower Drive; thence from said point of beginning and following the common property line of Lot 1, Tower Heights Subdivision, North 39 deg. 48 min. East, 95.10 feet to an iron pin; thence following the common property line of Lot 2 and part of Lot 3, Tower Heights Subdivision, North 40 deg. 08 min. East, 150.07 feet to an iron pin; thence following the common property line of part of Lot 3, Tower Heights Subdivision, North 40 deg. 34 min. East, 50.00 feet to an iron pin at the common property corner of Lots 3 and 4, Tower Heights Subdivision and property of Patrick J Schaad; thence following the common property line of Patrick J. Schaad the following three bearings and distances: South 46 deg. 10 min. East, 50.11 feet to an iron pin; thence South 14 deg. 26 min. East, 245.41 feet to an iron pin; thence South 40 deg. 06 min. West, 140.00 feet to an iron pin located in the northeastern right of way of Central Avenue Pike; thence with said right of way, North 52 deg. 05 min. West; 250.04 feet to an iron pin being the point of Beginning and containing 1.3246 acres (57,700 square feet), more or less;
BEING the same property conveyed to Ephant Group — Sparkle, LLC a Tennessee limited liability company, by Hart, LLC, a Tennessee limited liability company, by Warranty Deed dated December 2, 2022, of record under Instrument 202212020032655, in the Register's Office for Knox County, Tennessee.
The debtor is entitled to an accounting of the unpaid indebtedness upon request without additional charge. You may request such an accounting by writing to Kenneth Clark Hood, Laughlin, Nunnally, Hood, & Crum, PC, 100 South Main Street, Greeneville, Tennessee, 37743. Name of Debtor: Ephant Group – Sparkle, LLC. Name of Secured Party: Greeneville Federal Bank, FSB. It will be responsibility of the purchaser to obtain possession of the mobile home at purchaser's expense.
The address of the Subject Property as shown on the tax records for Knox County, Tennessee, is 5504 Central Avenue Pike, Knoxville, Tennessee, 37912-2720. (Control No. 068EE-005.02 – Assessed to Ephant Group – Sparkle, LLC) (Control No. 1513072 – Assessed to Sparkle Clean Car Wash)
It will be the responsibility of the successful bidder to obtain possession of the property at his expense. The successful bidder shall be responsible for any damage, vandalism, theft, destruction, etc., to the property. This sale may be subject to valid filed or unfiled mechanic's and materialmen's liens. No representations are made as to the validity or enforceability of any memorandum of mechanic's liens or any suit to enforce the same.
Interests in the property other than the Deed of Trust being foreclosed or matters affecting title known to the undersigned include the following:
1. Subject to a Permanent Maintenance Agreement for Storm Water Facilities of record in Book 2277, Page 940, in the Register's Office for Knox County, Tennessee;
2. Subject to building and setback lines, existing easements, and any notes, conditions, and limitations depicted and/or noted on the plats of record in Cabinet 7, Slide 68-D and Cabinet P, Slide 134-A, both in the Register's Office for Knox County, Tennessee;
3. This property may be subject to fees, dues, and assessments of a property owner's association. The actual existence of an association and the imposition of fees, dues and assessments are not typically of record in the Register of Deeds Office, and you should ascertain from your seller/borrower whether a property owners' association has actually been formed and whether there are any unpaid fees, dues, and assessments. We can make no certification as to this item.
4. Any acreage stated in the legal description attached hereto is for description purposes only. The quantity of the land can only be ascertained by a current and accurate survey of the land;
5. Knox County and City of Knoxville real property taxes and personal property taxes for the year 2026 are not yet due and payable but constitute a lien on the premises. Knox County and City of Knoxville real property taxes have been paid through the year 2022. Knox County and City of Knoxville real property taxes are delinquent for the years 2023, 2024, and 2025 in the amount of $15,151.51 (Knox County) and $21,997.31 (City of Knoxville), but interest and penalties continue to accrue on this amount. Knox County and City of Knoxville personal property taxes have been paid through the year 2022. Knox County and City of Knoxville personal property taxes are delinquent for the years 2023, 2024, and 2025 in the amount of $130.39 (Knox County) and $139.94 (City of Knoxville), but interest and penalties continue to accrue on this amount. The exact amount owing can be obtained from the local taxing authorities.
6. All property is subject to zoning ordinances which control the uses which may be made of the property. The undersigned makes no representation as to the uses which can be made of the premises in compliance with the applicable zoning ordinance.
7. Rights of parties in possession, if any.
The sale will be made as Substitute Trustee only, without covenants of seizen or warranties of title, subject to unpaid taxes and assessments owing on the property, and subject to all liens, encumbrances, easements, rights-of-way, set-back lines, restrictions, and covenants affecting the subject property having priority over the lien created by the subject deed of trust.
The proceeds derived from the sale of said property will be applied to the payment first to the expenses of this sale, including attorney's fees, then to the payment in full of the indebtedness including interest secured by said Trust Deed, and the balance, if any, to be paid to the parties legally entitled thereto.
This sale may be postponed or adjourned from time to time without readvertising the sale, and the sale may be dismissed and not conducted. The acting Trustee or any Substitute Trustee is authorized to appoint an agent or an auctioneer to conduct the sale, and any sale so made shall have the same validity as if made by the original Trustee. The sale shall be for cash, to the highest bidder.
