NOTICE OF MEETING
NEWTOWN TOWNSHIP ZONING HEARING BOARD
NOTICE is hereby given that the Newtown Township Zoning Hearing Board will hold a public meeting on Thursday, July 2, 2026, at 7:00 p.m. at the Township Municipal Building, 100 Municipal Drive, Newtown, PA 18940, to conduct a hearing on the following application and other such business properly before the Zoning Hearing Board:
1. Appeal 1231-25: Michael McDermott, Applicant and Owner, requests the following zoning relief to permit construction of a new single-family detached dwelling. The Applicant seeks a special exception pursuant to and variances from the Newtown Township Joint Municipal Zoning Ordinance of 2007, as amended, specifically a special exception pursuant to Section 905(D)(2)(a) to permit residential structures and stormwater management facilities within the floodplain, and variances from Section 401(B) to permit an impervious surface ratio of 20% where a maximum impervious surface ratio of 15% is permitted, Section 401(C) to permit a building coverage of 12% where a maximum building coverage of 10% is permitted, a front yard setback of 10 feet where a minimum front yard setback of 100 feet is required, and a rear yard setback of 10 feet to be measured from the edge of the easement area where a minimum rear yard setback of 60 feet is required, Section 401(D) to permit disturbance of 100% of the floodplain soils areas within the building envelope where no disturbance is permitted, Section 902(B)(2) to permit disturbance of 0.87 acres of floodplain soils areas where no disturbance is permitted, Section 903(B)(1) to permit structures to be located within the floodplain where such structures may not be constructed within the floodplain, 903(B)(5)(a) to permit disturbance of 32% of a woodlands area where a maximum disturbance of 15% is permitted, 905(D)(1) to permit a residential principal use in the floodplain where residential uses are not permitted within the floodplain, 905(D)(4)(h) to permit subsurface structures and utilities within the floodplain where utilities must be located and constructed to minimize or eliminate flood damage or impairment, and 905(D)(5)(b)(1) to permit a basement to not be elevated at least 1.5 feet above the 100-year flood elevation where any basement of a residential structure must sit at least 1.5 feet above the 100-year flood elevation. The Subject Property is located at 16 Eldridge Road, Lot 1, Brabazon Subdivision, Newtown Township, Newtown, PA, Tax Map Parcel # 29-7-23. The Subject Property is located in the CM – Conservation Management District.
2. Appeal 1255-26: SSKG, LLC, Applicant, and Crieghton Properties, LLC, Owner, request the following zoning relief to permit operation of a C-3 Commercial School Use in a 2-story building shared with two (2) other tenants. The Applicant seeks a variance from the Newtown Township Joint Municipal Zoning Ordinance of 2007, as amended, specifically from Section 601(A) to permit a C-3 Commercial School Use in the CC – Convenience Commercial District where such a use is not permitted. The Subject Property is located at 36 Richboro Road, Suite 1B, Newtown, PA, Tax Map Parcel # 29-11-47. The Subject Property is located in the CC – Convenience Commercial District.
3. Appeal 1256-26: Thomas J. and Patricia A. Lynch, Applicants and Owners, request the following zoning relief to permit construction of a 2-story rear addition. The Applicants seek a variance from the Hidden Lake Final Plan, as amended, specifically to permit an impervious surface ratio of 22.7% where a maximum impervious surface ratio of 17.5% is permitted. The Subject Property is located at 7 Lakeview Drive, Lot 4, Hidden Lake, Newtown Township, Newtown, PA, Tax Map Parcel # 29-3-48-6. The Subject Property is located in the CM – Conservation Management District.
4. Appeal 1257-26: AGB5 Holdings, LLC, Owner and Applicant, requests the following zoning relief to permit construction of an enclosure on a portion of the deck. The Applicant seeks variances from the Newtown Township Joint Municipal Ordinance of 2007, as amended, and Decision and Order 897-11 dated July 7, 2011, specifically from Section 803(E-5)(4) to permit 41 parking spaces where 85 parking spaces are required and zoning relief was previously granted to allow the use of 46 parking spaces, and from Condition #4 of Decision and Order 897-11 to permit enclosure of 443 square feet of deck area where no enclosure is permitted. The Subject Property is located at 203 North Sycamore Street, Newtown Township, Newtown, PA, Tax Map Parcel 29-12-16-1. The Subject Property is located in the TC – Town Commercial District.
