Application for Permit to Drill and Use a Supplement Well
NOTICE is hereby given on December 4, 2025, Sergio and Sandra Grajeda, PO Box 781, Hatch, NM 87937, filed with the STATE ENGINEER Application No. LRG-4893-POD5 for Permit to Drill and Use a Supplement Well for OSE Files LRG-4893-1, LRG-4893-2, LRG-4893-3 within the Lower Rio Grande Underground Water Basin of the State of New Mexico.
Dona Ana is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Las Cruces Sun News.
The applicnts have proposed drilling well LRG-4893-POD5 to a depth of 80 feet with a 16-inch casing, in a location within NE1/4SW1/4 of Section 34, Township 18S, Range 4W (NMPM) and more specifically located at or near where Latitude and Longtitude intersect at 32 degrees 42'N and 107 degrees 14'26.80"W (WGS84), on land owned by the applicants, which will supplement existing wells LRG-4893 and LRG-4893-S, located on property owned by the applicants within the SE1/4 NW1/4 of said Section 34 (NMPM) and more specifically described where Latitude and Longtitude intersect at 32 degrees 42'5.43"N & 107 degrees 14'26.70"W (WGS84), respectively, and well LRG-4893-POD4 located on property owned by the applicants within the NE1/4 SW1/4 of said Section 34 (NMPM) and more specifically described where Latitude and LOngtitude intersect at 32 degress 41'55.34"N and 107 degrees 14'21.58"W (WGS84) for the continued diversion of the amount of water subject to all conditions and provisions contained in the August 22, 2011 Final Judment and Settlement Agreement in Stream System Issue No. 101, SS-97-101, combined with surface water from the Elephant Butte Irrigation District, for the irrigation of 44.01 acres of land, and for the irrigation of 0.42 acres with groundwater only, all owned by the applicants, all located within the center of said Section 34 as described in Subfile Orde Nos. LRR 2800500081 and LRR 280050083 of the Third Judicial District Court, Dona Ana County, State of New Mexico. The applicant has requested emergency authorization to drill the proposed well under NMSA, 1978, Section 72-12-24. The site proposed well LRG-4893-POD5 will be located southwest of Salem, NM and may be found approximately 0.50 miles southeast of the intersection of Rancho Bonito Rd. & Ted Brown Rd.

Any person, firm or corportion or other entity assertin standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer's complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be basedd on: (1) Impairment; if impairment, you must specifically identify your water rights; and /or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicte, with the State Engineer, 1680 Hickory Loop, Suite J. Las Cruces, NM 88005, on or before April 10, 2026. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, 575-524-6160. If not valid protest or objection filed, The State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
