Notice of Adoption of Ordinance No. 3110
Notice is hereby given of the title and of a general summary of the subject matter contained in an ordinance duly adopted and approved by the City Council of the City of Las Cruces, New Mexico, on June 15, 2026, relating to the authorization and issuance of the City's Gross Receipts Tax Improvement Revenue Bonds, Series 2026. Complete copies of the Ordinance are available for public inspection during the normal and regular business hours of the City Clerk, Las Cruces City Hall, 700 North Main Street Las Cruces, New Mexico.
The title of the Ordinance is:
AN ORDINANCE AUTHORIZING THE ISSUANCE AND SALE OF THE CITY OF LAS CRUCES, NEW MEXICO GROSS RECEIPTS TAX IMPROVEMENT REVENUE BONDS, SERIES 2026 IN AN AGGREGATE PRINCIPAL AMOUNT NOT TO EXCEED $22,150,000 FOR THE PURPOSE OF (1) PLANNING, DESIGNING, CONSTRUCTING, PURCHASING, FURNISHING, EQUIPPING, REHABILITATING, MAKING ADDITIONS TO OR MAKING IMPROVEMENTS TO PUBLIC BUILDINGS AND FACILITIES, INCLUDING THE ACQUISITION OF LAND THEREFORE; (2) CONSTRUCTING, RECONSTRUCTING, RESURFACING, REPAIRING OR OTHERWISE IMPROVING STREETS OR ROADWAYS AND CONSTRUCTING DRAINAGE IMPROVEMENTS; (3) ACQUIRING AND EQUIPPING PUBLIC SAFETY VEHICLES; (4) FUNDING THE RESERVE FUND FOR THE SERIES 2026 BONDS; AND (5) PAYING THE EXPENSES RELATED TO THE ISSUANCE OF THE SERIES 2026 BONDS; PROVIDING THAT THE SERIES 2026 BONDS WILL BE PAYABLE AND COLLECTIBLE FROM THE REVENUES DERIVED FROM (1) A FIRST LIEN, BUT NOT AN EXCLUSIVE FIRST LIEN, ON THE 0.3250% MUNICIPAL GROSS RECEIPTS TAX IMPOSED PURSUANT TO ORDINANCE NO. 3072 AND (2) A SUBORDINATE LIEN, BUT NOT AN EXCLUSIVE SUBORDINATE LIEN, ON THE 0.50% MUNICIPAL GROSS RECEIPTS TAX REVENUES IMPOSED PURSUANT TO ORDINANCE NOS. 385 AND 427; DELEGATING AUTHORITY TO THE CITY MANAGER AND CITY FINANCIAL SERVICES DIRECTOR TO EXECUTE AND DELIVER A PRICING CERTIFICATE AND BOND PURCHASE AGREEMENT FOR THE SALE OF THE SERIES 2026 BONDS TO THE PURCHASER.
A general summary of the Ordinance is:
The Ordinance authorizes the issuance and sale of the City of Las Cruces, New Mexico Gross Receipts Tax Improvement Revenue Bonds, Series 2026, in an aggregate principal amount not to exceed $22,150,000 for the purpose of (1) planning, designing, constructing, purchasing, furnishing, equipping, rehabilitating, making additions to or making improvements to public buildings and facilities, including the acquisition of land therefore, including, but not limited to recreational facilities, library facilities, public safety facilities; (2) constructing, reconstructing, resurfacing, repairing or otherwise improving streets or roadways and constructing drainage improvements, including the acquisition of rights of way necessary therefore; (3) acquiring and equipping public safety vehicles; (4) funding the Reserve Fund for the Series 2026 Bonds, if required by the Purchaser; and (5) paying the Expenses related to the issuance of the Series 2026 Bonds; provides that the Series 2026 Bonds will be payable and collectible from a first lien, but not an exclusive first lien, on the revenues derived from the 0.3250% municipal gross receipts tax revenues of the City imposed pursuant to Ordinance No. 3072 and a subordinate lien, but not an exclusive subordinate lien, on the 0.50% municipal gross receipts tax imposed pursuant to Ordinance Nos. 385 and 427; provides that the maturity dates, interest rates, redemption provisions and other details of the Series 2026 Bonds will be as established in the Pricing Certificate, and delegates authority to the City Manager or City Financial Services Director to execute and deliver the Pricing Certificate; provides a form of the Series 2026 Bonds; approves preparation, execution and delivery of certain documents relating to the Series 2026 Bonds; makes covenants for the benefit of owners of the Series 2026 Bonds; ratifies action previously taken in connection with the Series 2026 Bonds; and repeals all action in conflict with the Ordinance.
This notice constitutes compliance with § 6-14-6 N.M.S.A. 1978.
