Paramount Theater Attic Space
NOTICE TO BIDDERS
Sealed bids for the renovation of the Paramount Theater Attic Space will be received by the City of Middletown Board of Estimate and Apportionment (BOE), at City of Middletown Public Works Office (16 James Street, Middletown, NY 10940), until 3:30 P.M. local time on Thursday November 13, 2025. Bids will be publicly opened and read at 4:00 P.M. at the BOE meeting. The project consists of various structural safety upgrades throughout the Paramount Theatre attic space, and the path to access the space. These include adding guardrails, constructing a new steel stair unit to access the space, and installing fall restraint strong points within the space.
Bids will be received for a single-prime contract. Bids shall be on a lump sum and unit price basis, with additive/deduct alternate bid items as indicated in the Bid Proposal Form.
The issuing office for the bidding documents is: M.G. McLaren Engineering and Land Surveying, P.C., 530 Chestnut Ridge Road, Woodcliff Lake, NJ. Complete sets of the drawings, specifications, and bid forms, becoming available to the public on Monday October 13, 2025, may be obtained via email inquiry to Nadia.itani@kci.com.
Please note Nadia.itani@kci.com is the designated location and means for distributing and obtaining all bid package information. Only those contract documents obtained in this manner will enable a prospective bidder to be identified as an official plan holder of record. The provider takes no responsibility for the completeness of contract documents obtained from other sources. Contract documents obtained from other sources many not be accurate or may not contain addenda that may have been issued.
A pre-bid conference will be held at 10:00AM local time on Thursday October 30, 2025 at the City of Middletown Public Works Office (16 James Street, Middletown, NY 10940). A site walkthrough will follow. Attendance at the pre-bid conference is highly encouraged but is not mandatory. Bidders may also visit the site at their convenience upon request and coordination with the Theater representatives.
Bidders shall promptly notify the engineer if there are any errors, omissions, conflicts, ambiguity, etc. within the contract documents. The above items and/or questions shall be submitted in writing via email to Nadia.itani@kci.com . Interpretations or clarifications considered necessary will be issued via addenda posted to the aforementioned email address. Questions must be received on or before 12:00 PM., EST, November 6, 2025. Questions received after this date may not be answered. Only questions answered by formal written addenda will be binding. Oral and other interpretations or clarifications will be without legal effect.
Bid security shall be furnished in accordance with the instructions to bidders.
Bidders on this work will be required to comply with the President’s Executive Order No’s: 11,246 and 11,375, which prohibit discrimination in employment regarding race, creed, color, sex, or national origin. Statement of Non-Collusion: Bidders on the contract are required to execute a non-collusive bidding certificate pursuant to Section 103D of the General Municipal Law of the State of New York.
Security for Faithful Performance: The successful bidder will be required to furnish performance and labor and material payment bonds written by firms licensed to do business in New York State, each in the amount of one hundred percent (100%) of the contract amounts in accordance with the provisions of the contract documents.
Sales and Use of Tax Exemptions: The City of Middletown is exempt from the payment of sales and compensation use taxes of the State of New York and of cities and counties on all materials, equipment, and supplies sold to the City of Middletown pursuant to this contract. Also exempt from such taxes are purchases by the Contractor and his subcontractors of materials, equipment, and supplies to be sold to the City of Middletown pursuant to this contract, including tangible personal property to be incorporated in any structure, building, or other real property forming part of the project. These taxes are not to be included in the bid.
Attention of bidders is particularly called to the requirement as to conditions of employment to be observed and minimum wage rates paid under the contract, Section 3, Segregated Facilities, Section 109, and Executive Order 11246. The requirements for bidders and contractors under this order, which concerns non-discrimination in employment, are explained in the contract documents. Bidders are also required to comply with the provisions of Section 291-299 of the Executive Law of the State of New York.
All bids shall be binding for a period of sixty (60) days after the bid opening date. The City of Middletown reserves the right to reject any and all bids and to waive any informalities therein.
Where state and local requirements differ from federal, the federal requirements shall be followed.
