TOWN OF BELVIDERE PLANNING BOARD
RESOLUTION REGARDING FINDINGS OF FACT AND CONCLUSIONS OF LAW
REGARDING THE APPLICATION OF INDIGO BELVIDERE, INC.
FOR MINOR SITE PLAN APPROVAL AND CHANGE OF USE TOGETHER WITH "C" VARIANCE AND WAIVER RELIEF FOR BLOCK 6, LOT 14 (164 MARKET STREET)
Resolution:
RESOLVED, that the Applicant, INDIGO BELVIDERE, INC., is granted minor site plan approval, change of use approval, "c" variance relief for the sign, and the submission waivers and partial waivers as set forth above, subject to the following conditions:
A. The terms of this approval are to be strictly in accordance with the plans, testimony, and representations presented at the public hearing, and the same are incorporated into this resolution by reference. The Applicant shall perform the work in accordance with the plans submitted in connection with the application, as to be revised subject to the approval of the Board's Professionals as set forth above and in the review correspondence.
B. The Applicant shall comply in all respects with the Board Engineer's Review correspondence dated April 2, 2026, marked Exhibit B-1, as clarified during the testimony and except as set forth above.
C. The Water Street access driveway shall be converted to a one-way driveway, with motorists entering the site only from Water Street, and the site plan shall be revised to indicate "One Way" and "Do Not Enter" signs, including the associated details.
D. The lower Market Street exit shall remain gated (via bollard and chain as depicted on the plan) for emergency access and shall be equipped with a Knox box or other emergency access device to the satisfaction of the Board Engineer. The "Chain Across Emergency Access Drive" detail shall be revised to indicate a thirty-six (36) inch minimum footing depth, and the Town shall be furnished with the access code for any locking mechanism on the chain.
E. All site and security lighting shall be downward-facing. The site plan shall be revised to add lighting, and the Applicant shall conduct a night lighting test to the satisfaction of the Board Engineer as a condition of the issuance of a certificate of occupancy. All exterior lighting, including the sign, shall be turned off when the dispensary is closed and after staff leaves the site.
F. There shall be no drive-up or drive-through window.
G. There shall be no see-through windows permitting a view of the interior of the dispensary.
H. The Applicant shall provide an armed security guard, and a security guard shall be present outside the building during all deliveries (loading and unloading).
I. The HVAC system shall include odor-control and filtration measures to address any odor from the retail product being detectable off-site.
J. The Applicant shall appear before and obtain the review of the Town's Historic Preservation Advisory Commission regarding the sign's consistency with the historic character of the Town. The sign shall be consistent with Section 505-97I of the Zoning Ordinance and shall not project above the roof peak.
K. The Applicant shall obtain any and all other necessary governmental approvals, if applicable, including but not limited to the Warren County Planning Board and the State of New Jersey (including the Cannabis Regulatory Commission).
L. The Applicant shall maintain a positive balance in its escrow account to reimburse the Town for its professional expenses in the review of this application and compliance with this approval.
