ORDINANCE NO. 3134 AN ORDINANCE TO REZONE ALL, OR PORTIONS OF, THE PROPERTIES LOCATED AT 7332, 7430, 7478, 7546, 7610, AND 7640 S. 27TH ST. FROM RS-1 SINGLE-FAMILY RESIDENTIAL DISTRICT, RS-2 SINGLE-FAMILY RESIDENTIAL DISTRICT, ER EQUESTRIAN RESIDENTIAL DISTRICT TO RS-4 SINGLE-FAMILY RESIDENTIAL DISTRICT (NO CHANGE TO FW FLOODWAY DISTRICT). (TAX KEY NOS. 762-9007-001, 762-9992-003, 762-9991-003, 785-9999-003, 785-9001-003, 785-9002-002) (2nd Aldermanic District) WHEREAS, the property owner representative, Brian Konyn, Walden OC, LLC, and future developer representative, Mark Lake, OC 27, LLC, have applied to rezone the properties located at 7332, 7430, 7478, 7546, 7610, and 7640 S. 27th St. from Rs-1 Single-Family Residential District, Rs-2 Single-Family Residential District, ER Equestrian Residential District to Rs-4 Single-Family Residential District (no change to FW Floodway District); and, WHEREAS, the Plan Commission reviewed said application at its July 22, 2025 meeting and recommended that the rezoning of the properties at 7332, 7430, 7478, 7546, 7610, and 7640 S. 27th St. to Rs-4 Single-Family Residential District (no change to FW Floodway District) be approved; and, WHEREAS, the Common Council held a public hearing on said application on September 2, 2025, at which time all interested parties appeared and were heard; and, WHEREAS, following said public hearing, with the favorable recommendation of the Plan Commission, and having determined that the proposed rezoning is consistent with the Comprehensive Land Use Plan of the City of Oak Creek, the Common Council is of the opinion that the best interests of the City of Oak Creek would be served if the Rs-4 Single Family Residential District rezoning of the properties located at 7332, 7430, 7478, 7546, 7610, and 7640 S. 27th St. (no change to FW Floodway District) were approved for the lands described below. NOW, THEREFORE, BE IT RESOLVED, the Common Council of the City of Oak Creek does hereby ordain as follows: SECTION I. Should any term or provision of this ordinance be found to be invalid by a court of competent jurisdiction, the remaining terms and provisions shall remain in full force and effect. SECTION III. All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby repealed. SECTION IV. This ordinance shall take effect and be in force from and after its passage and publication. Introduced this 2nd day of September , 2025.
