AN ORDINANCE TO ESTABLISH/REZONE ALL, OR PORTIONS OF, THE PROPERTIES LOCATED AT 7412, 7430, 7478, AND 7546 S. 27TH ST. TO PLANNED UNIT DEVELOPMENT OVERLAY DISTRICT (PUD).

WHEREAS, the property owner representative, Brian Konyn, Walden OC, LLC, and future developer representative, Mark Lake, OC 27, LLC, have applied to establish a Planned Unit Development (PUD) for a multi-family development on the properties at 7412, 7430, 7478, and 7546 S. 27th St.;
WHEREAS, the Plan Commission reviewed said application at its July 22, 2025 meeting and recommended that the establishment of/rezoning of all, or portions of, the properties located at 7412, 7430, 7478, and 7546 S. 27th St. to Planned Unit Development Overlay District (PUD) be approved; and,
WHEREAS, the Common Council held a public hearing on said application on September 2, 2025, at which time all interested parties appeared and were heard; and,
WHEREAS, following said public hearing, with the favorable recommendation of the Plan Commission, and having determined that the proposed establishment of/rezoning is consistent with the Comprehensive Land Use Plan of the City of Oak Creek, the Common Council is of the opinion that the best interests of the City of Oak Creek would be served if the Planned Unit Development Overlay District (PUD) rezoning of the properties located at 7412, 7430, 7478, and 7546 S. 27th St. were approved for the lands described below.
NOW, THEREFORE, BE IT RESOLVED, the Common Council of the City of Oak Creek does hereby ordain as follows:
SECTION I. To promote the general welfare, public safety and general planning within the City of Oak Creek, all of or portions of the properties located at 7412, 7430, 7478, and 7546 S. 27th St., legally described below, are hereby rezoned to Planned Unit Development Overlay District (PUD), and the Zoning Map of Chapter 17 of the Municipal Code is amended to reflect the rezoning:
Being a part of the Northwest 1/4 and Southwest 1/4 of Section 7, Township 5 North, Range 22 East, in the City of Oak Creek, Milwaukee County, Wisconsin, described as follows
Commencing at the southwest corner of the Northwest 1/4 of said Section 7, Thence North 89°09'56" East along the south line of said Northwest 1/4, 95 01 feet to the east right of way line of South 27th Street - State Trunk Highway "241" and the Point of Beginning,
Thence the following courses along the east right of way line of said South 27th Street North 00°00'33" West parallel to the west line of said Northwest 1/4, 107 01 feet; North 89°59'27" East, 10 00 feet, North 00°00'33" West, 120 00 feet, South 89°59'27" West, 5 00 feet, North 00°00'33" West, 116 72 feet, North 09°50'55" West, 117 04 feet, North 00°00'33" West, 203 10 feet; North 89°59'27" East, 20.00 feet,
Thence continuing North 89°59'27" East, 265 00 feet, Thence South 26°22'01" East, 598 00 feet, Thence South 00°02'32" East, 219 00 feet, Thence South 89°57'28" West, 304 08 feet, Thence North 82°18'39" West, 111 50 feet, Thence South 89°57'28" West, 121 00 feet, Thence North 00°02'32" West, 78 00 feet to the Point of Beginning,
Containing 332,369 square feet (7 6301 acres) of land Gross, more or less
BE IT FURTHER RESOLVED that said Planned Unit Development Overlay District (PUD) is subject to the Conditions and Restrictions recommended for approval by the Plan Commission on August 26, 2025, attached hereto and incorporated herein by reference. No alteration or modification of the approved Conditions & Restrictions shall be permitted without approval by the Common Council.
SECTION II. The terms and provisions of this ordinance are severable. Should any term or provision of this ordinance be found to be invalid by a court of competent jurisdiction, the remaining terms and provisions shall remain in full force and effect.
SECTION III. All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby repealed.
SECTION IV. This ordinance shall take effect and be in force from and after its passage and publication.
