Notice of an Approved Administrative Settlement Pursuant to 42 U.S.C. § 9613(f)
Brownfield redevelopment of 900 Cleveland Pike, known as 900 at Cleveland Park Site, Site # 19-769
The Division of Remediation (hereinafter "DoR") has accepted into its Brownfield Program an approximate 1.9-acre parcel of property owned by the Metropolitan Development and Housing Agency, a Tennessee quasi-governmental entity formed under Tennessee law pursuant to Tenn. Code Ann. § 13-20-101 et seq. (hereinafter "MDHA Voluntary Party") to facilitate redevelopment of the Site by Nashville Leased Housing Associates III, Limited Partnership (hereinafter "NLHA Voluntary Party") (hereinafter, the "NLHA Voluntary Party" and the "MDHA Voluntary Party" collectively shall be referred to as the "Voluntary Parties"). The Brownfield Voluntary Agreement (hereinafter "Agreement") among the Voluntary Parties and the DoR includes liability protection for the Voluntary Parties and any successor parties, including protection against third-party contribution claims regarding matters identified and addressed in the Agreement. This notice serves the dual purpose of notice of the terms of the Agreement to the general public and to third parties who may hold contribution claims under 42 U.S.C. § 9601 et seq.
The NLHA Voluntary Party has redeveloped the subject property into a multi-story apartment complex including two levels of parking with liner residential spaces along the east side and five levels of apartments above. Additional Site improvements include paved walkways, green space courtyards on top of the second level parking deck, and a subgrade stormwater management/filtration system. New underground utilities are also installed at the Site. The Site was originally comprised of seven contiguous parcels formerly owned and operated by various parties. The Site supported residential and commercial uses and included a gasoline station, various auto repair businesses, a printing business, and a dry-cleaner. The DoR acknowledges that the Site has been impacted by historical operations.
Soil is known to be contaminated with volatile organic compounds (VOCs), polycyclic aromatic hydrocarbons (PAHs), arsenic, lead, and chromium. There is no evidence that these contaminants pose a threat to move off-site.
The Site has been the subject of environmental investigations, the results of which have been reviewed by the DoR. All reports of the investigation and remediation of the Site are on file with the DoR. These investigations concluded that the Site has been impacted by real or perceived hazardous substances, solid wastes, or other pollutants relating to the historical operations at the Site and/or at neighboring properties. Due to the presence of these constituents, approximately 7,500 cubic yards of contaminated debris-laden soil were removed and disposed of as industrial waste material at an approved landfill, and eleven (11) former petroleum underground storage tanks were removed and closed. A Notice of Land Use Restrictions will be placed on the Site to limit certain future activities thereon. These and other measures required by the DoR under the Agreement for the Site will ensure protection of human health and the environment.

The DoR is accepting written comments from the general public on the Agreement for thirty (30) days after the date of publication of this notice, and these comments should be mailed to Mr. Swanson at the above address. The DoR is also accepting written comments from persons that possess contribution claims regarding the matters addressed in the Agreement for a period of thirty (30) days. These comments also should be mailed to Mr. Swanson at the foregoing address.
