By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Shawn M. Tracey and Judi-Ann M. Tracey to Mortgage Electronic Registration Systems, Inc., as nominee for IndyMac Bank, F.S.B., a federally chartered savings bank, its successors and assigns, dated February 17, 2007 and recorded with the Plymouth County Registry of Deeds at Book 34240, Page 200, as affected by Agreed Order of Dismissal recorded in said Registry of Deeds in Book 42126 at Page 196, as affected by a Loan Modification recorded on June 19, 2013 in Said Registry of Deeds at Book 43228, Page 105, subsequently assigned to Deutsche Bank National Trust Company, as Trustee of the Home Equity Mortgage Loan AssetBacked Trust Series INABS 2007-A, Home Equity Mortgage Loan Asset-Backed Certificates, Series INABS 2007-A under the Pooling and Servicing agreement dated Mar 1, 2007 and its successors and assigns by Mortgage Electronic Registration Systems, Inc. by assignment recorded in said Plymouth County Registry of Deeds at Book 35835, Page 259 for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction at 1:00 PM on February 23, 2026 at 84 River Street, Middleboro, MA, all and singular the premises described in said Mortgage, to wit:
All that certain parcel of land situate in the County of Plymouth, and Commonwealth of Massachusetts, being bounded and described as follows:
Begin at the intersection of River and Auburn Streets; thence, North 16° West, 1731 feet by Auburn Street to an iron pipe by the side of the Street; thence South 64° 10 West, 328 feet to an iron pipe; thence South 52° 10 West, 180 feet to the Taunton River, passing an iron pipe 20 feet from the river; thence, about 385 feet by the River; thence, South 40°20 East,1573 feet to River Street, passing an iron pipe 16 feet from the River and following a stone wall part of the way; thence, 131 feet by River Street to the Point of Beginning, together with the buildings thereon.
Being the same property as conveyed from Elizabeth A. Maltais, Executrix under the Will of Harison Newcomb to Shawn M. Tracy and Judi-Ann M. Tracy, Husband and Wife as Tenants by the Entirety, as described in Deed Book 13703 at Page 342, Dated 07/19/1995, Recorded 07/19/1995 in PLYMOUTH County Records.

The premises are to be sold subject to and with the benefit of all easements, restrictions, encroachments, building and zoning laws, liens, unpaid taxes, tax titles, water bills, municipal liens and assessments, rights of tenants and parties in possession, and attorney’s fees and costs.
TERMS OF SALE:
A deposit of FIVE THOUSAND DOLLARS AND 00 CENTS ($5,000.00) in the form of a certified check, bank treasurer’s check or money order will be required to be delivered at or before the time the bid is offered. The successful bidder will be required to execute a Foreclosure Sale Agreement immediately after the close of the bidding. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified check, bank treasurer’s check or other check satisfactory to Mortgagee’s attorney. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney.
