Notice of Mortgagee's Sale of Real Estate
By virtue and in execution of the Power of Sale contained in a certain Open-End Mortgage Deed, Security Agreement and Assignment of Leases and Rents given by Creative 3uild, LLC and Raysa I. De Leon to Equity Trust Company Custodian FBO Account Number 200254586 IRA dated November 7, 2024 and recorded with the Southern Bristol County Registry of Deeds (the "Registry") in Book 15147 at Page 302, of which mortgage the undersigned is the present holder, for breach of the conditions of said Open-End Mortgage Deed, Security Agreement and Assignment of Leases and Rents and for the purpose of foreclosing the same will be sold at Public Auction at 11 o'clock A.M. on the 15th day of January, 2026 at 64 North Street, New Bedford, Massachusetts, all and singular the premises described in said mortgage,
To wit:
The land together with any buildings thereon, in said New Bedford, Bristol County, Massachusetts, bounded and described as follows:
BEGINNING at the northwest corner of said lot at the point of intersection of the south line of North Street with the east line of Hill Street;
Thence EASTERLY in said south line of North Street, twenty-nine and 75/100 (29.75) feet to land now or formerly of Hilda D. Mitron, et al.;
Thence SOUTHERLY by said land fifty-two (52) feet to land now or formerly of Hilda D. Mitron, et al.
Thence WESTERLY in line of last-named land thirty-one (31) feet to the east line of Hill Street; and
Thence NORTHERLY in said east line of Hill Street fifty-one (41) feet to the place of beginning.
CONTAINING five and 74/100 (5.74) square rods, more or less.
Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
Terms of sale: A deposit of ten thousand dollars ($10,000) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at the offices of Clavell & Associates, P.C., 355 Union Street, New Bedford, MA 02740 within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. In the event of an error in this publication, the description of the premises contained in said mortgage shall control.
