CASE No. 25 MISC 000236 (GHP)
Elizabeth M. Kelly, as personal representative of the Estate of Richard J. Donovan, Jr.
v.
The Unknown Trustees and Beneficiaries of the Do No Wrong Realty Trust, et al.
TO: any unknown, unascertained, or unlocated successor trustees and beneficiaries of the Do No Wrong Realty Trust u/d/t June 10, 1985, and all other persons interested in this Trust:
You are hereby notified that a complaint has been filed by the above-named plaintiff in which you are named as an interested party. This complaint concerns a certain parcel of land in Rockland, Plymouth County, and said Commonwealth being known as and numbered 103 Grove Street, Unit 319. Plaintiff contends the Property is owned of record by Loretta D. Goodrich, correct name Loretta D. Goodridge, as Trustee of the Do No Wrong Realty Trust u/d/t June 10, 1985 ("Trust") recorded with Plymouth County Registry of Deeds in Book 6214, Page 256. Plaintiff further contends that Richard J. Donovan, deceased, was the sole beneficiary of the Trust although the trust document as recorded did not list its beneficiaries. Plaintiff maintains that divorce records of Mr. Donovan indicate that he purchased the Property in a cash transaction, with solely his own funds. Plaintiff maintains that, in connection with Mr. Donovan's divorce, and as an accommodation to Mr. Donovan, Loretta Goodridge held title to the Property as trustee only, and that the true beneficial ownership was at all times in Mr. Donovan. Plaintiff now seeks declaratory judgment that Mr. Donovan died as the sole legal owner of the Property, free of any claims from Loretta Goodridge or her estate or heirs, and that the court should establish title in the heirs and successors of Mr. Donovan.
This complaint may be examined at the Land Court, Boston, Massachusetts, or online at www.masseourts.org. Information on how to search Land Court dockets is available on the Land Court website: www.mass.gov/how-to/find-a-land-court-case-docket. If you fail to do so, judgment by default will be taken against you for relief demanded in the complaint. Unless otherwise provided by Rule 13(a), your answer must state as a counterclaim any claim which you may have against the plaintiff which arise out of the transaction or occurrence that is the subject matter of the plaintiffs' claim, or you will thereafter be barred from making such claim in any other action.
It is ORDERED that notice be given by publishing a copy of this notice once in The Brockton Enterprise, a newspaper of general circulation in Plymouth County, and said Commonwealth, at least thirty days before the twenty-sixth day of January, 2026.
